외국인보호위원회는 위원장 1명을 포함한 9명의 위원으로 성별을 고려하여 구성한다. 이 경우 법무부 소속이 아닌 위원(이하 이 조에서 "외부위원"이라 한다)을 과반수 이상으로 하여야 하며, 외부위원에는 제2항제3호부터 제6호까지에 해당하는 사람 중에서 대법원장 및 대한변호사협회장이 추천하는 사람 각 1명을 포함하여야 한다.
The Foreigner Protection Committee shall be composed of nine members, including one chairperson, taking into consideration gender. In this case, the number of members who are not belonging to the Ministry of Justice (hereinafter referred to as "external members" in this Article) shall be a majority or more, and external members shall include one person each recommended by the Chief Justice of the Supreme Court and the President of the Korean Bar Association from among those falling under subparagraphs 3 to 6 of paragraph 2.
외국인보호위원회의 위원은 다음 각 호의 어느 하나에 해당하는 자격을 갖추어야 한다.
1. 법무부의 고위공무원단에 속하는 공무원 또는 4급 이상의 공무원
2. 대통령령으로 정하는 기관의 고위공무원단에 속하는 공무원 또는 4급 이상의 공무원으로서 해당 기관의 장이 지명하는 사람
3. 판사, 검사 또는 변호사로 5년 이상 재직하고 있거나 재직하였던 사람
4. 「고등교육법」 제2조에 따른 학교에서 법학, 정치학, 사회학, 심리학 등을 가르치는 부교수 이상 또는 이에 상당하는 직에 5년 이상 재직하고 있거나 재직하였던 사람
5. 「비영리민간단체 지원법」에 따라 등록된 비영리민간단체에서 인권 분야에 10년 이상 근무하고 있거나 근무하였던 사람
6. 그 밖에 제1호부터 제5호까지에 준하는 사람으로서 외국인보호 업무에 전문적인 지식과 경험이 풍부한 사람
Members of the Foreigner Protection Committee shall have qualifications falling under any of the following subparagraphs: 1. A public official belonging to the senior civil service corps of the Ministry of Justice or a public official of grade 4 or higher. 2. A public official belonging to the senior civil service corps or a public official of grade 4 or higher of an agency designated by Presidential Decree, who is nominated by the head of the relevant agency. 3. A person who has served or has served as a judge, prosecutor, or lawyer for five years or more. 4. A person who has served or has served for five years or more as an associate professor or higher, or in an equivalent position, in law, political science, sociology, psychology, etc., at a school under Article 2 of the 「Higher Education Act」. 5. A person who has worked or has worked for ten years or more in the human rights field at a non-profit civilian organization registered under the 「Act on Support for Non-profit Civilian Organizations」. 6. A person otherwise equivalent to subparagraphs 1 to 5, who has abundant professional knowledge and experience in foreigner protection services.
외국인보호위원회의 위원장(이하 "위원장"이라 한다)은 외부위원 중에서 법무부장관이 위촉한다.
The chairperson of the Foreigner Protection Committee (hereinafter referred to as "chairperson") shall be appointed by the Minister of Justice from among the external members.
외국인보호위원회에 3명 이내의 상임위원을 둔다. 상임위원은 고위공무원단에 속하는 일반직공무원 또는 4급 이상 공무원으로서 「국가공무원법」 제26조의5에 따른 임기제공무원으로 보하고, 상임위원의 임명에 관한 사항은 대통령령으로 정한다.
The Foreigner Protection Committee shall have up to three standing members. Standing members shall be appointed as general public officials belonging to the senior civil service corps or public officials of grade 4 or higher as fixed-term public officials under Article 26-5 of the 「State Public Officials Act」, and matters concerning the appointment of standing members shall be determined by Presidential Decree.
외국인보호위원회의 위원 중 상임위원이 아닌 위원은 법무부장관이 임명 또는 위촉한다.
Members of the Foreigner Protection Committee who are not standing members shall be appointed or recommended by the Minister of Justice.
