송환대상외국인은 출국하기 전까지 출국대기실에서 대기하여야 한다. 다만, 지방출입국ㆍ외국인관서의 장은 대통령령으로 정하는 바에 따라 직권으로 또는 송환대상외국인(그의 법정대리인등을 포함한다)의 신청에 따라 송환대상외국인의 상태, 신청사유, 그 밖의 사항을 고려하여 출입국항 내의 지정된 장소에서 조건을 붙여 대기하게 할 수 있다.
An alien subject to repatriation shall stay in a departure waiting room until departure. Provided, however, that the head of a local immigration and foreign affairs office may, by order or upon application by an alien subject to repatriation (including his/her legal representative, etc.), and considering the condition of the alien subject to repatriation, the reason for the application, and other matters as prescribed by Presidential Decree, allow the alien to wait under conditions in a designated place within the immigration port.
출국대기실의 운영 및 안전대책, 출국대기실 입실 외국인의 인권존중, 급양 및 관리에 관하여는 제56조의3, 제56조의5부터 제56조의7까지 및 제57조를 준용한다. 이 경우 "피보호자"는 "송환대상외국인"으로, "보호시설"은 "출국대기실"로 본다.
Articles 56-3, 56-5 through 56-7, and 57 shall apply mutatis mutandis to the operation and safety measures of the departure waiting room, respect for the human rights of aliens in the departure waiting room, and provision of meals and management. In this case, "protected person" shall be deemed "alien subject to repatriation," and "detention facility" shall be deemed "departure waiting room."
제1항에도 불구하고 출국대기실이 설치되지 않은 출입국항(항구를 말한다)의 경우 그 출입국항을 관할하는 지방출입국ㆍ외국인관서의 장은 송환대상외국인이 타고 온 선박의 장이나 운수업자에게 법무부령으로 정하는 바에 따라 송환대상외국인의 관리를 요청할 수 있다. 이 경우 관리를 요청받은 선박의 장이나 운수업자는 송환대상외국인이 출국하기 전까지 선박 내에서 관리하여야 한다.
Notwithstanding paragraph ①, in the case of an immigration port (referring to a seaport) where no departure waiting room is established, the head of the local immigration and foreign affairs office having jurisdiction over such immigration port may request the captain of the vessel or the transporter on which the alien subject to repatriation arrived to manage the alien subject to repatriation, as prescribed by the Ordinance of the Ministry of Justice. In this case, the captain of the vessel or the transporter who received the request for management shall manage the alien subject to repatriation within the vessel until his/her departure.
