제81조 출입국관리공무원 등의 외국인 동향조사

출입국관리공무원과 대통령령으로 정하는 관계 기관 소속 공무원은 외국인이 이 법 또는 이 법에 따른 명령에 따라 적법하게 체류하고 있는지와 제46조제1항 각 호의 어느 하나에 해당되는지를 조사하기 위하여 다음 각 호의 어느 하나에 해당하는 자를 방문하여 질문하거나 그 밖에 필요한 자료를 제출할 것을 요구할 수 있다. <개정 2020.2.4>
1. 외국인
2. 외국인을 고용한 자
3. 외국인의 소속 단체 또는 외국인이 근무하는 업소의 대표자
4. 외국인을 숙박시킨 자
Immigration control officers and officers belonging to related agencies as prescribed by Presidential Decree may visit persons falling under any of the following subparagraphs to investigate whether foreigners are lawfully staying in accordance with this Act or orders under this Act, and whether they fall under any of the subparagraphs of Article 46 (1), and may ask questions or request the submission of other necessary data. <Amended by 2020.2.4> 1. Persons who provide accommodation to foreigners
출입국관리공무원은 허위초청 등에 의한 외국인의 불법입국을 방지하기 위하여 필요하면 외국인의 초청이나 국제결혼 등을 알선ㆍ중개하는 자 또는 그 업소를 방문하여 질문하거나 자료를 제출할 것을 요구할 수 있다.
Immigration control officers may, if necessary to prevent illegal entry of foreigners due to false invitation, etc., visit persons who arrange or broker invitations or international marriages of foreigners, etc., or their places of business, and may ask questions or request the submission of data.
출입국관리공무원은 거동이나 주위의 사정을 합리적으로 판단하여 이 법을 위반하였다고 의심할 만한 상당한 이유가 있는 외국인에게 정지를 요청하고 질문할 수 있다.
Immigration control officers may request a foreigner suspected of violating this Act based on a reasonable judgment of their conduct or surrounding circumstances to stop and may ask questions.
제1항이나 제2항에 따라 질문을 받거나 자료 제출을 요구받은 자는 정당한 이유 없이 거부하여서는 아니 된다.
A person who is questioned or requested to submit data pursuant to paragraph ① or ② shall not refuse without justifiable grounds.
