Article 120 (Temporary Suspension of Insurance Benefits)
제120조 보험급여의 일시 중지

공단은 보험급여를 받고자 하는 사람이 다음 각 호의 어느 하나에 해당되면 보험급여의 지급을 일시 중지할 수 있다. <개정 2010.5.20, 2020.5.26, 2021.1.26>
1. 요양 중인 근로자가 제48조제1항에 따른 공단의 의료기관 변경 요양 지시를 정당한 사유 없이 따르지 아니하는 경우
2. 제59조에 따라 공단이 직권으로 실시하는 장해등급 또는 진폐장해등급 재판정 요구에 따르지 아니하는 경우
3. 제114조나 제115조에 따른 보고ㆍ서류제출 또는 신고를 하지 아니하는 경우
4. 제117조에 따른 질문이나 조사에 따르지 아니하는 경우
5. 제119조에 따른 진찰 요구에 따르지 아니하는 경우
The Corporation may temporarily suspend the payment of insurance benefits if a person who wishes to receive insurance benefits falls under any of the following subparagraphs. <Amended by Act No. 10317, May 20, 2010; Act No. 17260, May 26, 2020; Act No. 17902, Jan. 26, 2021> 1. Where a worker undergoing medical treatment fails to comply with the Corporation's directive to change medical treatment facilities under Article 48 (1) without justifiable grounds. 2. Where the worker fails to comply with the request for re-evaluation of disability grade or pneumoconiosis disability grade conducted ex officio by the Corporation under Article 59. 3. Where the worker fails to report, submit documents, or file a notification under Article 114 or Article 115. 4. Where the worker fails to comply with the inquiry or investigation under Article 117. 5. Where the worker fails to comply with the request for medical examination under Article 119.
제1항에 따른 일시 중지의 대상이 되는 보험급여의 종류, 일시 중지의 기간 및 일시 중지 절차는 대통령령으로 정한다.
The types of insurance benefits subject to temporary suspension under paragraph (1), the period of temporary suspension, and the procedure for temporary suspension shall be prescribed by Presidential Decree.
