제123조의2 학생연구자에 대한 특례

「연구실 안전환경 조성에 관한 법률」 제2조제1호에 따른 대학ㆍ연구기관등은 제6조에도 불구하고 이 법의 적용을 받는 사업으로 본다.
Universities, research institutes, etc., as defined in Article 2(1) of the 「Act on the Creation of Safe Research Environments」 shall be deemed businesses subject to this Act, notwithstanding Article 6.
「연구실 안전환경 조성에 관한 법률」 제2조제8호에 따른 연구활동종사자 중 같은 조 제1호에 따른 대학ㆍ연구기관등이 수행하는 연구개발과제에 참여하는 대통령령으로 정하는 학생 신분의 연구자(이하 이 조에서 "학생연구자"라 한다)는 제5조제2호에도 불구하고 이 법을 적용할 때에는 그 사업의 근로자로 본다.
Student researchers, as defined by Presidential Decree, who are in a student status and participate in research and development tasks conducted by universities, research institutes, etc., as defined in Article 2(1) of the 「Act on the Creation of Safe Research Environments」, among research personnel as defined in Article 2(8) of the same Act (hereinafter referred to as "student researchers" in this Article), shall be deemed workers of the business when this Act is applied, notwithstanding Article 5(2).
제2항에 따라 이 법의 적용을 받는 학생연구자에 대한 보험 관계의 성립ㆍ소멸 및 변경, 보험료의 산정ㆍ신고ㆍ납부, 보험료나 그 밖에 징수금의 징수에 필요한 사항은 보험료징수법에서 정하는 바에 따른다.
Matters necessary for the establishment, extinction, and alteration of insurance relationships, the calculation, reporting, and payment of insurance premiums, and the collection of insurance premiums or other collected amounts for student researchers subject to this Act pursuant to Paragraph ② shall be governed by the 「Act on the Collection of Insurance Premiums」.
학생연구자에 대한 보험급여의 산정 기준이 되는 평균임금은 고용노동부장관이 고시하는 금액으로 한다.
The average wage used as the basis for calculating insurance benefits for student researchers shall be the amount publicly announced by the Minister of Employment and Labor.
학생연구자에 대한 보험급여 지급사유인 업무상의 재해의 인정 기준은 대통령령으로 정한다.
The criteria for recognizing industrial accidents as grounds for payment of insurance benefits for student researchers shall be determined by Presidential Decree.
학생연구자에게 제36조제1항제2호에 따른 휴업급여 또는 같은 항 제6호에 따른 상병보상연금을 지급하는 경우 제54조, 제56조제2항, 제67조 및 제69조제1항은 적용하지 아니한다.
When paying temporary disability benefits under Article 36(1)(2) or long-term disability pensions under Article 36(1)(6) to student researchers, Articles 54, 56(2), 67, and 69(1) shall not apply.
학생연구자에 대한 보험급여의 지급 등에 필요한 사항은 대통령령으로 정한다.
Matters necessary for the payment of insurance benefits for student researchers, etc., shall be determined by Presidential Decree.
