Article 48 (Treatment at a Different Medical Institution)
제48조 의료기관 변경 요양

공단은 다음 각 호의 어느 하나에 해당하는 사유가 있으면 요양 중인 근로자를 다른 산재보험 의료기관으로 옮겨 요양하게 할 수 있다. <개정 2010.5.20>
1. 요양 중인 산재보험 의료기관의 인력ㆍ시설 등이 그 근로자의 전문적인 치료 또는 재활치료에 맞지 아니하여 다른 산재보험 의료기관으로 옮길 필요가 있는 경우
2. 생활근거지에서 요양하기 위하여 다른 산재보험 의료기관으로 옮길 필요가 있는 경우
3. 제43조제1항제2호에 따른 상급종합병원에서 전문적인 치료 후 다른 산재보험 의료기관으로 옮길 필요가 있는 경우
4. 그 밖에 대통령령으로 정하는 절차를 거쳐 부득이한 사유가 있다고 인정되는 경우
When any of the following reasons exist, the Corporation may have a worker undergoing treatment transferred to another industrial accident insurance medical institution for treatment. <Amended by Act No. 10317, May 20, 2010> 1. When it is necessary to transfer to another industrial accident insurance medical institution because the personnel, facilities, etc. of the industrial accident insurance medical institution where the worker is undergoing treatment are not suitable for the worker's specialized treatment or rehabilitation treatment. 2. When it is necessary to transfer to another industrial accident insurance medical institution in order to undergo treatment in the worker's place of residence. 3. When it is necessary to transfer to another industrial accident insurance medical institution after specialized treatment at a tertiary general hospital as prescribed in Article 43 (1) 2. 4. In other cases where there are unavoidable reasons recognized after going through the procedures prescribed by Presidential Decree.
요양 중인 근로자는 제1항제1호부터 제3호까지의 어느 하나에 해당하는 사유가 있으면 공단에 의료기관 변경 요양을 신청할 수 있다. <개정 2021.1.26>
A worker undergoing treatment may apply for treatment at a different medical institution to the Corporation when any of the reasons falling under subparagraphs 1 to 3 of paragraph ① exist. <Amended by Act No. 17931, Jan. 26, 2021>
