제63조 유족보상연금 수급자격자의 범위

①

유족보상연금을 받을 수 있는 자격이 있는 사람(이하 "유족보상연금 수급자격자"라 한다)은 근로자가 사망할 당시 그 근로자와 생계를 같이 하고 있던 유족(그 근로자가 사망할 당시 대한민국 국민이 아닌 사람으로서 외국에서 거주하고 있던 유족은 제외한다) 중 배우자와 다음 각 호의 어느 하나에 해당하는 사람으로 한다. 이 경우 근로자와 생계를 같이 하고 있던 유족의 판단 기준은 대통령령으로 정한다. <개정 2010.6.4, 2012.12.18, 2017.12.19, 2018.6.12, 2020.5.26, 2023.8.8>

1. 부모 또는 조부모로서 각각 60세 이상인 사람
2. 자녀로서 25세 미만인 사람
2의2. 손자녀로서 25세 미만인 사람
3. 형제자매로서 19세 미만이거나 60세 이상인 사람
4. 제1호부터 제3호까지의 규정 중 어느 하나에 해당하지 아니하는 자녀ㆍ부모ㆍ손자녀ㆍ조부모 또는 형제자매로서 「장애인복지법」 제2조에 따른 장애인 중 고용노동부령으로 정한 장애 정도에 해당하는 사람

The persons eligible to receive the survivor's pension (hereinafter referred to as "eligible recipients of survivor's pension") shall be the surviving family members who were living together and sharing means of livelihood with the worker at the time of the worker's death (excluding surviving family members who were residing overseas and were not nationals of the Republic of Korea at the time of the worker's death), comprising the spouse and any person falling under any of the following subparagraphs. Parents or grandparents aged 60 or older, respectively. 2. Children under the age of 25. 2. of 2. Grandchildren under the age of 25. 3. Siblings under the age of 19 or aged 60 or older. 4. Children, parents, grandchildren, grandparents, or siblings who do not fall under any of subparagraphs 1 through 3, and who are persons with disabilities as defined in Article 2 of the 「Act on Welfare of Persons with Disabilities」, and whose degree of disability is determined by an Ordinance of the Ministry of Employment and Labor.

제1항을 적용할 때 근로자가 사망할 당시 태아(胎兒)였던 자녀가 출생한 경우에는 출생한 때부터 장래에 향하여 근로자가 사망할 당시 그 근로자와 생계를 같이 하고 있던 유족으로 본다.

유족보상연금 수급자격자 중 유족보상연금을 받을 권리의 순위는 배우자ㆍ자녀ㆍ부모ㆍ손자녀ㆍ조부모 및 형제자매의 순서로 한다.
