유족보상연금 수급자격자인 유족이 다음 각 호의 어느 하나에 해당하면 그 자격을 잃는다. <개정 2012.12.18, 2018.6.12, 2020.5.26, 2023.8.8>

1. 사망한 경우
2. 재혼한 때(사망한 근로자의 배우자만 해당하며, 재혼에는 사실상 혼인 관계에 있는 경우를 포함한다)
3. 사망한 근로자와의 친족 관계가 끝난 경우
4. 자녀가 25세가 된 때
4의2. 손자녀가 25세가 된 때
4의3. 형제자매가 19세가 된 때
5. 제63조제1항제4호에 따른 장애인이었던 사람으로서 그 장애 상태가 해소된 경우
6. 근로자가 사망할 당시 대한민국 국민이었던 유족보상연금 수급자격자가 국적을 상실하고 외국에서 거주하고 있거나 외국에서 거주하기 위하여 출국하는 경우
7. 대한민국 국민이 아닌 유족보상연금 수급자격자가 외국에서 거주하기 위하여 출국하는 경우

유족보상연금을 받을 권리가 있는 유족보상연금 수급자격자(이하 "유족보상연금 수급권자"라 한다)가 그 자격을 잃은 경우에 유족보상연금을 받을 권리는 같은 순위자가 있으면 같은 순위자에게, 같은 순위자가 없으면 다음 순위자에게 이전된다.

유족보상연금 수급권자가 3개월 이상 행방불명이면 대통령령으로 정하는 바에 따라 연금 지급을 정지하고, 같은 순위자가 있으면 같은 순위자에게, 같은 순위자가 없으면 다음 순위자에게 유족보상연금을 지급한다. <개정 2010.1.27>
