①

공단은 제84조제1항제1호 또는 같은 조 제3항제1호에 해당하는 자(이하 "부정수급자"라 한다)로서 매년 직전 연도부터 과거 3년간 다음 각 호의 어느 하나에 해당하는 자의 명단을 공개할 수 있다. 이 경우 같은 조 제2항에 따른 연대책임자의 명단을 함께 공개할 수 있다.

1. 부정수급 횟수가 2회 이상이고 부정수급액의 합계가 1억원 이상인 자
2. 1회의 부정수급액이 2억원 이상인 자

The Corporation may disclose the list of persons who fall under Article 84 (1) 1. or Article 84 (3) 1. (hereinafter referred to as "persons who received benefits illegally") and who fall under any of the following subparagraphs for the three years prior to the immediately preceding year, on an annual basis. In this case, the list of persons jointly and severally liable under Article 84 (2) may be disclosed together. 1. Persons whose number of illegal benefit receipts is two or more times and the total amount of illegally received benefits is 100 million won or more 2. Persons whose amount of illegally received benefits in one instance is 200 million won or more

부정수급자 또는 연대책임자의 사망으로 명단 공개의 실효성이 없는 경우 등 대통령령으로 정하는 경우에는 제1항에 따른 명단을 공개하지 아니할 수 있다.

In cases where disclosure of the list is ineffective due to the death of a person who received benefits illegally or a person jointly and severally liable, or in other cases as prescribed by Presidential Decree, the list under Paragraph ① may not be disclosed.

공단은 이의신청이나 그 밖의 불복절차가 진행 중인 부당이득징수결정처분에 대해서는 해당 이의신청이나 불복절차가 끝난 후 명단을 공개할 수 있다.

The Corporation may disclose the list after an objection application or any other appeal procedure is completed for a decision to recover unjustly gained benefits for which an objection application or other appeal procedure is underway.

④

공단은 제1항에 따른 공개대상자에게 고용노동부령으로 정하는 바에 따라 미리 그 사실을 통보하고 소명의 기회를 주어야 한다.

The Corporation shall notify the persons subject to disclosure under Paragraph ① of that fact in advance and provide an opportunity to explain, as prescribed by the Ministry of Employment and Labor ordinance.

그 밖에 명단 공개의 방법 및 절차 등에 필요한 사항은 고용노동부령으로 정한다.
