공단은 제87조에 따라 「자동차손해배상 보장법」 제2조제7호가목에 따른 보험회사등(이하 이 조에서 "보험회사등"이라 한다)에게 구상권을 행사하는 경우 그 구상금 청구액을 협의ㆍ조정하기 위하여 보험회사등과 구상금협의조정기구를 구성하여 운영할 수 있다.
The Corporation, when exercising its subrogation rights against insurance companies, etc. under Article 2, subparagraph 7, item (a) of the 「Act on Automobile Liability Insurance」, pursuant to Article 87, may establish and operate a subrogation claim consultation and adjustment organization with such insurance companies, etc. (hereinafter referred to as "insurance companies, etc." in this Article) to consult and adjust the amount of the subrogation claim.
공단과 보험회사등은 제1항에 따른 협의ㆍ조정을 위하여 상대방에게 필요한 자료의 제출을 요구할 수 있다. 이 경우 자료의 제출을 요구받은 상대방은 특별한 사정이 없으면 그 요구에 따라야 한다.
The Corporation and insurance companies, etc. may request the other party to submit necessary data for consultation and adjustment under paragraph 1. In this case, the other party who is requested to submit data shall comply with such request unless there are special circumstances.
제1항 및 제2항에 따른 구상금협의조정기구의 구성 및 운영 등에 관하여 필요한 사항은 공단이 정한다.
Matters necessary for the establishment and operation, etc. of the subrogation claim consultation and adjustment organization under paragraphs 1 and 2 shall be determined by the Corporation.
