제91조의3 진폐보상연금

진폐보상연금은 업무상 질병인 진폐에 걸린 근로자(이하 "진폐근로자"라 한다)에게 지급한다.
A pneumoconiosis compensation pension shall be paid to a worker who has contracted pneumoconiosis, an occupational disease (hereinafter referred to as "pneumoconiosis worker").
진폐보상연금은 제5조제2호 및 제36조제6항에 따라 정하는 평균임금을 기준으로 하여 별표 6에 따라 산정하는 진폐장해등급별 진폐장해연금과 기초연금을 합산한 금액으로 한다. 이 경우 기초연금은 최저임금액의 100분의 60에 365를 곱하여 산정한 금액으로 한다.
The pneumoconiosis compensation pension shall be the sum of the pneumoconiosis disability pension calculated according to the pneumoconiosis disability grade in attached Table 6 and the basic pension, based on the average wage determined pursuant to Article 5, Subparagraph 2 and Article 36, Paragraph 6. In this case, the basic pension shall be calculated by multiplying 60 percent of the minimum wage by 365.
진폐보상연금을 받던 사람이 그 진폐장해등급이 변경된 경우에는 변경된 날이 속한 달의 다음 달부터 기초연금과 변경된 진폐장해등급에 해당하는 진폐장해연금을 합산한 금액을 지급한다.
If a person receiving a pneumoconiosis compensation pension has their pneumoconiosis disability grade changed, the sum of the basic pension and the pneumoconiosis disability pension corresponding to the changed pneumoconiosis disability grade shall be paid from the month following the month in which the change occurred.
