제95조 산업재해보상보험및예방기금의 설치 및 조성

고용노동부장관은 보험사업, 산업재해 예방 사업에 필요한 재원을 확보하고, 보험급여에 충당하기 위하여 산업재해보상보험및예방기금(이하 "기금"이라 한다)을 설치한다. <개정 2010.6.4>
The Minister of Employment and Labor shall establish the Industrial Accident Compensation Insurance and Prevention Fund (hereinafter referred to as the "Fund") to secure financial resources necessary for insurance projects and industrial accident prevention projects, and to cover insurance benefits. <Amended by Act No. 10339, Jun. 4, 2010>
기금은 보험료, 기금운용 수익금, 적립금, 기금의 결산상 잉여금, 정부 또는 정부 아닌 자의 출연금 및 기부금, 차입금, 그 밖의 수입금을 재원으로 하여 조성한다.
The Fund shall be financed by insurance premiums, proceeds from the operation of the Fund, reserves, surplus from the settlement of accounts of the Fund, contributions and donations from the government or non-governmental sources, borrowed funds, and other revenues.
정부는 산업재해 예방 사업을 수행하기 위하여 회계연도마다 기금지출예산 총액의 100분의 3의 범위에서 제2항에 따른 정부의 출연금으로 세출예산에 계상(計上)하여야 한다.
For the purpose of carrying out industrial accident prevention projects, the government shall account for expenditures in the budget each fiscal year, by including contributions from the government under paragraph ② within the scope of 3/100 of the total amount of budget expenditure for the Fund.
