법 제80조제3항에 따라 장해보상을 하여야 하는 신체장해 등급의 결정 기준은 별표 6과 같다. <개정 2008.6.25>
The criteria for determining the physical disability grade for which disability compensation shall be paid pursuant to Article 80 (3) of the Act shall be as set forth in Attached Table 6. <Amended on June 25, 2008>
별표 6에 따른 신체장해가 둘 이상 있는 경우에는 정도가 심한 신체장해에 해당하는 등급에 따른다. 다만, 다음 각 호의 경우에는 해당 호에서 정하여 조정한 등급에 따른다. 이 경우 그 조정된 등급이 제1급을 초과하는 때에는 제1급으로 한다.
1. 제5급 이상에 해당하는 신체장해가 둘 이상 있는 경우 : 정도가 심한 신체장해에 해당하는 등급에 3개 등급 인상
2. 제8급 이상에 해당하는 신체장해가 둘 이상 있는 경우 : 정도가 심한 신체장해에 해당하는 등급에 2개 등급 인상
3. 제13급 이상에 해당하는 신체장해가 둘 이상 있는 경우 : 정도가 심한 신체장해에 해당하는 등급에 1개 등급 인상
Where there are two or more physical disabilities according to Attached Table 6, the grade shall be determined by the grade corresponding to the more severe physical disability. Provided, however, that in cases falling under any of the following subparagraphs, the grade adjusted as prescribed in the relevant subparagraph shall apply. In such cases, if the adjusted grade exceeds Grade 1, it shall be deemed Grade 1. 1. Where there are two or more physical disabilities corresponding to Grade 5 or higher: The grade corresponding to the more severe physical disability shall be increased by 3 grades. 2. Where there are two or more physical disabilities corresponding to Grade 8 or higher: The grade corresponding to the more severe physical disability shall be increased by 2 grades. 3. Where there are two or more physical disabilities corresponding to Grade 13 or higher: The grade corresponding to the more severe physical disability shall be increased by 1 grade.
별표 6에 해당하지 아니하는 신체장해가 있는 경우에는 그 장해 정도에 따라 별표 6에 따른 신체장해에 준하여 장해보상을 하여야 한다.
Where there is a physical disability not falling under Attached Table 6, disability compensation shall be paid by analogy with the physical disability according to Attached Table 6, according to the degree of the disability.
