법 제82조제2항에 따른 유족의 범위는 다음 각 호와 같다. 이 경우 유족보상의 순위는 다음 각 호의 순서에 따르되, 같은 호에 해당하는 경우에는 그 적힌 순서에 따른다. <개정 2008.6.25>

1. 근로자가 사망할 때 그가 부양하고 있던 배우자(사실혼 관계에 있던 자를 포함한다), 자녀, 부모, 손(孫) 및 조부모
2. 근로자가 사망할 때 그가 부양하고 있지 아니한 배우자, 자녀, 부모, 손 및 조부모
3. 근로자가 사망할 때 그가 부양하고 있던 형제자매
4. 근로자가 사망할 때 그가 부양하고 있지 아니한 형제자매

The scope of surviving family members under Article 82 (2) of the Act shall be as follows. In this case, the order of priority for surviving family compensation shall follow the order of the following subparagraphs, and in the case of belonging to the same subparagraph, it shall follow the order written therein. <Amended on Jun. 25. 2008> 1. Spouse (including those in a de facto marital relationship), children, parents, grandchildren, and grandparents whom the worker was supporting at the time of death. 2. Spouse, children, parents, grandchildren, and grandparents whom the worker was not supporting at the time of death. 3. Siblings whom the worker was supporting at the time of death. 4. Siblings whom the worker was not supporting at the time of death.

유족의 순위를 정하는 경우에 부모는 양부모를 선순위로 친부모를 후순위로 하고, 조부모는 양부모의 부모를 선순위로 친부모의 부모를 후순위로 하되, 부모의 양부모를 선순위로 부모의 친부모를 후순위로 한다.

When determining the order of surviving family members, adoptive parents shall take precedence over biological parents, and the parents of adoptive parents shall take precedence over the parents of biological parents; however, with respect to parents, their adoptive parents shall take precedence over their biological parents.

제1항 및 제2항에도 불구하고 근로자가 유언이나 사용자에 대한 예고에 따라 제1항의 유족 중의 특정한 자를 지정한 경우에는 그에 따른다.

Notwithstanding paragraphs ① and ②, if the worker designates a specific person among the surviving family members under paragraph ① through a will or by notice to the employer, such designation shall apply.
