이 법은 상시 5명 이상의 근로자를 사용하는 모든 사업 또는 사업장에 적용한다. 다만, 동거하는 친족만을 사용하는 사업 또는 사업장과 가사(家事) 사용인에 대하여는 적용하지 아니한다.
This Act shall apply to all businesses or workplaces where 5 or more workers are regularly employed. However, this Act shall not apply to businesses or workplaces where only relatives living together are employed, nor to domestic workers.
상시 4명 이하의 근로자를 사용하는 사업 또는 사업장에 대하여는 대통령령으로 정하는 바에 따라 이 법의 일부 규정을 적용할 수 있다.
For businesses or workplaces where 4 or fewer workers are regularly employed, some provisions of this Act may be applied as prescribed by Presidential Decree.
이 법을 적용하는 경우에 상시 사용하는 근로자 수를 산정하는 방법은 대통령령으로 정한다. <신설 2008.3.21>
The method of calculating the number of regularly employed workers when applying this Act shall be prescribed by Presidential Decree. <Newly established March 21, 2008>
