Article 47-2 (Establishment and Operation of the Real Estate Transaction Order Disruption Reporting Center)
제47조의2 부동산거래질서교란행위 신고센터의 설치ㆍ운영

국토교통부장관은 부동산 시장의 건전한 거래질서를 조성하기 위하여 부동산거래질서교란행위 신고센터(이하 이 조에서 "신고센터"라 한다)를 설치ㆍ운영할 수 있다. <개정 2023.6.1>
The Minister of Land, Infrastructure and Transport may establish and operate a Real Estate Transaction Order Disruption Reporting Center (hereinafter referred to as the "Reporting Center" in this Article) to foster a sound transaction order in the real estate market. <Amended by Act No. 18518, Jun. 1, 2023>
누구든지 부동산중개업 및 부동산 시장의 건전한 거래질서를 해치는 다음 각 호의 어느 하나에 해당하는 행위(이하 이 조에서 "부동산거래질서교란행위"라 한다)를 발견하는 경우 그 사실을 신고센터에 신고할 수 있다. <신설 2023.6.1>
1. 제7조부터 제9조까지, 제18조의4 또는 제33조제2항을 위반하는 행위
2. 제48조제2호에 해당하는 행위
3. 개업공인중개사가 제12조제1항, 제13조제1항ㆍ제2항, 제14조제1항, 제15조제3항, 제17조, 제18조, 제19조, 제25조제1항, 제25조의3 또는 제26조제3항을 위반하는 행위
4. 개업공인중개사등이 제12조제2항, 제29조제2항 또는 제33조제1항을 위반하는 행위
5. 「부동산 거래신고 등에 관한 법률」 제3조, 제3조의2 또는 제4조를 위반하는 행위
Any person who discovers an act that harms the sound transaction order of real estate brokerage and the real estate market, as falling under any of the following subparagraphs (hereinafter referred to as "Real Estate Transaction Order Disruption Act" in this Article), may report the facts to the Reporting Center. <Newly Inserted by Act No. 18518, Jun. 1, 2023> 1. An act that violates Articles 7 through 9, Article 18-4, or Article 33 (2). 2. An act falling under Article 48 (2). 3. An act that a licensed real estate agent violates Article 12 (1), Article 13 (1) or (2), Article 14 (1), Article 15 (3), Article 17, Article 18, Article 19, Article 25 (1), Article 25-3, or Article 26 (3). 4. An act that licensed real estate agents, etc., violate Article 12 (2), Article 29 (2), or Article 33 (1). 5. An act that violates Article 3, Article 3-2, or Article 4 of the 「Act on Reporting Real Estate Transactions, etc.」.
신고센터는 다음 각 호의 업무를 수행한다. <개정 2023.6.1>
1. 부동산거래질서교란행위 신고의 접수 및 상담
2. 신고사항에 대한 확인 또는 시ㆍ도지사 및 등록관청 등에 신고사항에 대한 조사 및 조치 요구
3. 신고인에 대한 신고사항 처리 결과 통보
The Reporting Center shall perform the following duties. <Amended by Act No. 18518, Jun. 1, 2023> 1. Receiving and counseling reports of Real Estate Transaction Order Disruption Acts. 2. Confirming reported matters or requesting investigations and measures on reported matters from the mayors of metropolitan cities, governors of provinces, or the registration authority. 3. Notifying the informant of the results of the processing of reported matters.
국토교통부장관은 제2항에 따른 신고센터의 업무를 대통령령으로 정하는 기관에 위탁할 수 있다. <개정 2023.6.1>
The Minister of Land, Infrastructure and Transport may entrust the duties of the Reporting Center under paragraph (2) to an agency prescribed by Presidential Decree. <Amended by Act No. 18518, Jun. 1, 2023>
제1항에 따라 설치된 신고센터의 운영 및 신고방법 등에 관한 사항은 대통령령으로 정한다. <개정 2023.6.1>
Matters concerning the operation of the Reporting Center established under paragraph (1) and reporting methods, etc., shall be prescribed by Presidential Decree. <Amended by Act No. 18518, Jun. 1, 2023>
