Article 9 (Objection to Minimum Wage Proposal)
제9조 최저임금안에 대한 이의 제기

고용노동부장관은 제8조제2항에 따라 위원회로부터 최저임금안을 제출받은 때에는 대통령령으로 정하는 바에 따라 최저임금안을 고시하여야 한다. <개정 2010.6.4>
When the Minister of Employment and Labor receives a minimum wage proposal from the Committee pursuant to Article 8(2), the Minister shall publicly announce the minimum wage proposal in accordance with the Presidential Decree. <Amended by Act No. 10337, Jun. 4, 2010>
근로자를 대표하는 자나 사용자를 대표하는 자는 제1항에 따라 고시된 최저임금안에 대하여 이의가 있으면 고시된 날부터 10일 이내에 대통령령으로 정하는 바에 따라 고용노동부장관에게 이의를 제기할 수 있다. 이 경우 근로자를 대표하는 자나 사용자를 대표하는 자의 범위는 대통령령으로 정한다. <개정 2010.6.4>
If a representative of workers or a representative of employers has an objection to the minimum wage proposal publicly announced pursuant to paragraph ①, such person may file an objection with the Minister of Employment and Labor within 10 days from the date of the public announcement, in accordance with the Presidential Decree. In this case, the scope of representatives of workers and representatives of employers shall be determined by Presidential Decree. <Amended by Act No. 10337, Jun. 4, 2010>
고용노동부장관은 제2항에 따른 이의가 이유 있다고 인정되면 그 내용을 밝혀 제8조제3항에 따라 위원회에 최저임금안의 재심의를 요청하여야 한다. <개정 2010.6.4>
If the Minister of Employment and Labor recognizes that an objection filed pursuant to paragraph ② is justified, the Minister shall clarify the contents thereof and request the Committee to re-deliberate the minimum wage proposal pursuant to Article 8(3). <Amended by Act No. 10337, Jun. 4, 2010>
고용노동부장관은 제3항에 따라 재심의를 요청한 최저임금안에 대하여 제8조제4항에 따라 위원회가 재심의하여 의결한 최저임금안이 제출될 때까지는 최저임금을 결정하여서는 아니 된다. <개정 2010.6.4>
The Minister of Employment and Labor shall not decide the minimum wage until a minimum wage proposal, which has been re-deliberated and resolved by the Committee pursuant to Article 8(4) in relation to the minimum wage proposal for which re-deliberation was requested pursuant to paragraph ③, is submitted. <Amended by Act No. 10337, Jun. 4, 2010>
