법 제70조제3항 전단에서 "대통령령으로 정하는 것"이란 근로의 대가로 받은 봉급, 급료, 보수, 세비(歲費), 임금, 상여, 수당, 그 밖에 이와 유사한 성질의 금품으로서 다음 각 호의 것을 제외한 것을 말한다. <개정 2015.6.30>

1.퇴직금
2.현상금, 번역료 및 원고료
3. 「소득세법」에 따른 비과세근로소득. 다만, 「소득세법」 제12조제3호차목ㆍ파목 및 거목에 따라 비과세되는 소득은 제외한다.

In the first part of Article 70(3) of the Act, "matters prescribed by Presidential Decree" refers to salary, wages, remuneration, stipends, pay, bonuses, allowances, and other monetary or other items of a similar nature received as compensation for labor, excluding the following: 1. Severance pay 2. Prize money, translation fees, and manuscript fees 3. Non-taxable earned income under the Income Tax Act. However, income that is non-taxable pursuant to Article 12(3)(cha), (pa), and (geo) of the Income Tax Act shall be excluded.

법 제70조제3항 후단에서 "보수 관련 자료가 없거나 불명확한 경우 등 대통령령으로 정하는 사유"란 다음 각 호의 어느 하나에 해당하는 경우를 말한다.

1. 보수 관련 자료가 없거나 불명확한 경우
2. 「최저임금법」 제5조에 따른 최저임금액 등을 고려할 때 보수 관련 자료의 신뢰성이 없다고 공단이 인정하는 경우

In the latter part of Article 70(3) of the Act, "reasons prescribed by Presidential Decree, such as when remuneration-related data is unavailable or unclear" refers to cases falling under any of the following subparagraphs: 1. When remuneration-related data is unavailable or unclear. 2. When the Corporation recognizes that the remuneration-related data is unreliable, taking into account the minimum wage amount pursuant to Article 5 of the Minimum Wage Act.

보수의 전부 또는 일부가 현물(現物)로 지급되는 경우에는 그 지역의 시가(時價)를 기준으로 공단이 정하는 가액(價額)을 그에 해당하는 보수로 본다.

When all or part of the remuneration is paid in kind, the value determined by the Corporation based on the market price in the relevant region shall be considered as the corresponding remuneration.

법 제70조제3항 후단에 따라 보건복지부장관이 고시하는 금액이 적용되는 기간 중에 사업장 근로자의 보수가 확인되는 경우에는 공단이 확인한 날이 속하는 달의 다음 달부터 그 고시 금액을 적용하지 아니한다.

If the remuneration of workers at a workplace is confirmed during a period when the amount notified by the Minister of Health and Welfare pursuant to the latter part of Article 70(3) of the Act applies, the notified amount shall not apply from the month following the month in which the date of confirmation by the Corporation falls.
