Article 70-4 (Disposition of Persons Who Fail to Pay Penalty Surcharges)
제70조의4 과징금 미납자에 대한 처분

보건복지부장관은 법 제99조제1항에 따라 과징금을 납부하여야 할 자가 납부기한까지 과징금을 내지 아니하면 같은 조 제5항 본문에 따라 납부기한이 지난 후 15일 이내에 독촉장을 발급하여야 한다. 이 경우 납부기한은 독촉장을 발급하는 날부터 10일 이내로 하여야 한다. <개정 2018.9.28>
The Minister of Health and Welfare shall, if a person liable to pay a penalty surcharge under Article 99(1) of the Act fails to pay it by the payment deadline, issue a demand notice within 15 days after the expiration of the payment deadline, pursuant to the main sentence of Article 99(5) of the Act. In this case, the payment deadline shall be within 10 days from the date of issuing the demand notice. <Amended on September 28, 2018>
보건복지부장관은 과징금을 납부하여야 할 자가 제1항에 따른 독촉장을 받고도 그 납부기한까지 과징금을 내지 아니하면 법 제99조제5항 본문에 따라 과징금 부과처분을 취소하고 법 제98조제1항에 따른 업무정지 처분을 하거나 국세 체납처분의 예에 따라 징수하여야 한다. <개정 2018.9.28>
If a person liable to pay a penalty surcharge fails to pay it by the payment deadline after receiving a demand notice under paragraph ①, the Minister of Health and Welfare shall, pursuant to the main sentence of Article 99(5) of the Act, revoke the penalty surcharge disposition and impose a business suspension disposition under Article 98(1) of the Act, or collect it in accordance with the example of disposition for arrears of national taxes. <Amended on September 28, 2018>
보건복지부장관은 법 제99조제5항 본문에 따라 과징금 부과처분을 취소하고 법 제98조제1항에 따른 업무정지 처분을 하는 경우에는 처분대상자에게 서면으로 그 내용을 통지하여야 한다. 이 경우 그 서면에는 처분의 변경사유와 업무정지 처분의 기간 등 업무정지 처분에 필요한 사항이 포함되어야 한다. <개정 2018.9.28>
When the Minister of Health and Welfare revokes the penalty surcharge disposition and imposes a business suspension disposition under Article 98(1) of the Act pursuant to the main sentence of Article 99(5) of the Act, he or she shall notify the subject of the disposition in writing.
