국내에 체류하는 재외국민 또는 외국인(이하 "국내체류 외국인등"이라 한다)은 법 제109조제6항 단서에 따라 다음 각 호의 구분에 따른 날에 가입자의 자격을 얻는다. <개정 2019.7.16>

1. 법 제109조제3항제2호에 해당하는 사람으로서 같은 항 제1호에 따른 기간 동안 국내에 거주한 경우: 해당 기간이 경과한 날
2. 법 제109조제3항제2호에 해당하는 사람으로서 같은 항 제1호에 따라 국내에 지속적으로 거주할 것으로 예상할 수 있는 사유에 해당하는 경우: 국내에 입국한 날
3. 그 밖에 보건복지부장관이 체류자격, 체류기간 및 체류경위 등을 고려하여 그 자격취득 시기를 국내거주 국민과 다르게 정할 필요가 있다고 인정하여 고시하는 경우: 해당 고시에서 정하는 날

A national residing abroad or a foreigner residing in Korea (hereinafter referred to as "foreigners, etc. residing in Korea") shall acquire the qualification of a subscriber on the day determined according to the following categories, pursuant to the proviso of Article 109(6) of the Act. <Amended on July 16, 2019> 1. A person falling under Article 109(3)2 of the Act who has resided in Korea for the period under Article 109(3)1 of the Act: The day on which the said period has elapsed. 2. A person falling under Article 109(3)2 of the Act who meets the grounds for expecting to reside continuously in Korea under Article 109(3)1 of the Act: The day of entry into Korea. 3. In cases where the Minister of Health and Welfare deems it necessary to set a different timing for acquiring qualification from that of nationals residing in Korea, taking into account their alien registration status, period of stay, circumstances of stay, etc., and publicly announces it: The day specified in the said public notice.

국내체류 외국인등은 법 제109조제6항 본문에서 준용하는 법 제10조에 따라 같은 조 제1항제1호ㆍ제4호 및 제5호에 따른 날에 가입자의 자격을 잃는다. 다만, 법 제109조제6항 단서에 따라 다음 각 호의 구분에 따른 날에도 그 자격을 잃는다. <개정 2019.6.11, 2019.7.16>

1. 직장가입자: 다음 각 목의 어느 하나에 해당하는 날
1. 가. 「출입국관리법」 제10조의2제1항제2호 및 「재외동포의 출입국과 법적 지위에 관한 법률」 제10조제1항에 따른 체류기간이 종료된 날의 다음 날
2. 나. 「출입국관리법」 제59조제3항에 따른 강제퇴거명령서를 발급받은 날의 다음 날
3. 다. 법 제109조제5항제2호에 따라 사용자가 직장가입자의 가입 제외를 신청한 날. 다만, 법 제8조제2항에 따라 직장가입자 자격취득 신고를 한 날부터 14일 이내에 가입 제외를 신청한 경우에는 그 자격취득일로 한다.
4. 라. 그 밖에 보건복지부장관이 체류자격, 체류기간 및 체류경위 등을 고려하여 그 자격상실 시기를 국내거주 국민과 다르게 정할 필요가 있다고 인정하여 고시하는 경우: 해당 고시에서 정하는 날
2. 지역가입자: 다음 각 목의 어느 하나에 해당하는 날
1. 가. 제1호가목 및 나목에 따른 날
2. 나. 재외국민 또는 체류기간이 종료되지 아니한 외국인이 출국 후 1개월이 지난 경우: 그 출국한 날의 다음 날
3. 다. 법 제109조제5항제2호에 따라 지역가입자가 가입 제외를 신청한 날. 다만, 보험료를 납부하지 않은 지역가입자 또는 최초로 보험료를 납부한 날부터 14일이 지나지 않은 지역가입자가 보건복지부장관이 정하여 고시하는 요건을 갖추고 가입 제외를 신청하는 경우에는 그 자격을 취득한 날로 한다.
4. 라. 그 밖에 보건복지부장관이 체류자격, 체류기간 및 체류경위 등을 고려하여 그 자격상실 시기를 국내 거주 국민과 다르게 정할 필요가 있다고 인정하여 고시하는 경우: 해당 고시에서 정하는 날

However, if the application for exclusion is made within 14 days from the date of reporting the acquisition of qualification as a workplace subscriber under Article 8(2) of the Act, it shall be the date of qualification acquisition. d. In cases where the Minister of Health and Welfare deems it necessary to set a different timing for the loss of qualification from that of nationals residing in Korea, taking into account their alien registration status, period of stay, circumstances of stay, etc., and publicly announces it: The day specified in the said public notice. 2. Regional subscriber: The day falling under any of the following sub-paragraphs. a. The days under sub-paragraphs a and b of item 1. b. For nationals residing abroad or foreigners whose period of stay has not expired, the day after 1 month has passed since their departure from Korea: The day after their departure. c. The day on which the regional subscriber applies for exclusion from subscription under Article 109(5)2 of the Act. However, in the case of a regional subscriber who has not paid premiums or a regional subscriber for whom 14 days have not passed since the date of their first premium payment, if they meet the requirements prescribed and publicly announced by the Minister of Health and Welfare and apply for exclusion from subscription, it shall be the date of qualification acquisition. d. In cases where the Minister of Health and Welfare deems it necessary to set a different timing for the loss of qualification from that of nationals residing in Korea, taking into account their alien registration status, period of stay, circumstances of stay, etc., and publicly announces it: The day specified in the said public notice.
