제45조 요양급여비용의 산정 등

요양급여비용은 공단의 이사장과 대통령령으로 정하는 의약계를 대표하는 사람들의 계약으로 정한다. 이 경우 계약기간은 1년으로 한다.
The medical care benefit costs shall be determined by contract between the President of the National Health Insurance Service and representatives of the pharmaceutical and medical circles designated by Presidential Decree. In this case, the contract period shall be one year.
제1항에 따라 계약이 체결되면 그 계약은 공단과 각 요양기관 사이에 체결된 것으로 본다.
When a contract is concluded pursuant to paragraph ①, the contract shall be deemed to have been concluded between the National Health Insurance Service and each medical institution.
제1항에 따른 계약은 그 직전 계약기간 만료일이 속하는 연도의 5월 31일까지 체결하여야 하며, 그 기한까지 계약이 체결되지 아니하는 경우 보건복지부장관이 그 직전 계약기간 만료일이 속하는 연도의 6월 30일까지 심의위원회의 의결을 거쳐 요양급여비용을 정한다. 이 경우 보건복지부장관이 정하는 요양급여비용은 제1항 및 제2항에 따라 계약으로 정한 요양급여비용으로 본다. <개정 2013.5.22>
The contract pursuant to paragraph ① shall be concluded by May 31 of the year in which the expiration date of the immediately preceding contract period falls, and if the contract is not concluded by the deadline, the Minister of Health and Welfare shall determine the medical care benefit costs by resolution of the Deliberation Committee by June 30 of the year in which the expiration date of the immediately preceding contract period falls. In this case, the medical care benefit costs determined by the Minister of Health and Welfare shall be deemed to be the medical care benefit costs determined by contract pursuant to paragraphs ① and ②. <Amended by Act No. 11776, May 22, 2013>
제1항 또는 제3항에 따라 요양급여비용이 정해지면 보건복지부장관은 그 요양급여비용의 명세를 지체 없이 고시하여야 한다.
When the medical care benefit costs are determined pursuant to paragraph ① or ③, the Minister of Health and Welfare shall promptly publicly announce the details of such medical care benefit costs.
공단의 이사장은 제33조에 따른 재정운영위원회의 심의ㆍ의결을 거쳐 제1항에 따른 계약을 체결하여야 한다.
The President of the National Health Insurance Service shall conclude the contract pursuant to paragraph ① after deliberation and resolution by the Financial Operations Committee under Article 33.
심사평가원은 공단의 이사장이 제1항에 따른 계약을 체결하기 위하여 필요한 자료를 요청하면 그 요청에 성실히 따라야 한다.
The Health Insurance Review and Assessment Service shall faithfully comply with requests for data necessary for the President of the National Health Insurance Service to conclude the contract pursuant to paragraph ①.
제1항에 따른 계약의 내용과 그 밖에 필요한 사항은 대통령령으로 정한다.
The contents of the contract pursuant to paragraph ① and other necessary matters shall be determined by Presidential Decree.
