제47조 요양급여비용의 청구와 지급 등

요양기관은 공단에 요양급여비용의 지급을 청구할 수 있다. 이 경우 제2항에 따른 요양급여비용에 대한 심사청구는 공단에 대한 요양급여비용의 청구로 본다.

제1항에 따라 요양급여비용을 청구하려는 요양기관은 심사평가원에 요양급여비용의 심사청구를 하여야 하며, 심사청구를 받은 심사평가원은 이를 심사한 후 지체 없이 그 내용을 공단과 요양기관에 알려야 한다.

제2항에 따라 심사 내용을 통보받은 공단은 지체 없이 그 내용에 따라 요양급여비용을 요양기관에 지급한다. 이 경우 이미 낸 본인일부부담금이 제2항에 따라 통보된 금액보다 더 많으면 요양기관에 지급할 금액에서 더 많이 낸 금액을 공제하여 해당 가입자에게 지급하여야 한다.

공단은 심사평가원이 제47조의4에 따라 요양급여의 적정성을 평가하여 공단에 통보하면 그 평가 결과에 따라 요양급여비용을 가산하거나 감액 조정하여 지급한다. 이 경우 평가 결과에 따라 요양급여비용을 가산하거나 감액하여 지급하는 기준은 보건복지부령으로 정한다. <개정 2022.6.10, 2022.12.27>
If the Health Insurance Review and Assessment Service notifies the Corporation of the results of evaluating the appropriateness of medical care benefits pursuant to Article 47-4, the Corporation shall pay the medical care benefit costs by adding to or deducting from them according to the evaluation results. 1. 「의료법」 제28조제1항에 따른 의사회ㆍ치과의사회ㆍ한의사회ㆍ조산사회 또는 같은 조 제6항에 따라 신고한 각각의 지부 및 분회
2. 「의료법」 제52조에 따른 의료기관 단체
3. 「약사법」 제11조에 따른 약사회 또는 같은 법 제14조에 따라 신고한 지부 및 분회
A medical care institution may have the following organizations act on its behalf for the claim for review pursuant to paragraph ②: 1. Medical associations, dental associations, Korean medicine associations, or midwife associations pursuant to Article 28 (1) of the 「Medical Service Act」, or their respective branches and chapters reported pursuant to Article 28 (6) of the same Act 2. Pharmaceutical associations pursuant to Article 11 of the 「Pharmaceutical Affairs Act」, or their branches and chapters reported pursuant to Article 14 of the same Act
제1항부터 제7항까지의 규정에 따른 요양급여비용의 청구ㆍ심사ㆍ지급 등의 방법과 절차에 필요한 사항은 보건복지부령으로 정한다. <개정 2022.12.27>
Matters necessary for the methods and procedures for claiming, reviewing, and paying medical care benefit costs pursuant to paragraphs ① through ⑦ shall be prescribed by the Ordinance of the Ministry of Health and Welfare.
