제85조(보험료등의 징수 순위) 보험료등은 국세와 지방세를 제외한 다른 채권에 우선하여 징수한다. 다만, 보험료등의 납부기한 전에 전세권ㆍ질권ㆍ저당권 또는 「동산ㆍ채권 등의 담보에 관한 법률」에 따른 담보권의 설정을 등기 또는 등록한 사실이 증명되는 재산을 매각할 때에 그 매각대금 중에서 보험료등을 징수하는 경우 그 전세권ㆍ질권ㆍ저당권 또는 「동산ㆍ채권 등의 담보에 관한 법률」에 따른 담보권으로 담보된 채권에 대하여는 그러하지 아니하다.
Translation
Insurance premiums, etc. shall be collected with priority over other claims, excluding national taxes and local taxes. However, when collecting insurance premiums, etc. from the proceeds of the sale of property for which a collateral right of superficies, pledge, mortgage, or security interest under the Act on Security over Movable Properties, Claims, etc. was registered or recorded before the due date for payment of insurance premiums, etc., this shall not apply to claims secured by the right of superficies, pledge, mortgage, or security interest under the Act on Security over Movable Properties, Claims, etc.
