제113조의2 민감정보 및 고유식별정보의 처리

보건복지부장관 및 공단(제1호의 경우에는 제25조의6에 따라 공단의 업무를 위탁받은 직업안정기관을 포함한다)은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조제1항에 따른 건강에 관한 정보, 같은 법 시행령 제18조제2호에 따른 범죄경력자료에 해당하는 정보, 같은 영 제19조제1호부터 제4호까지의 규정에 따른 주민등록번호, 여권번호, 운전면허의 면허번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2012.6.29, 2015.6.30, 2016.11.29, 2020.7.1, 2021.6.29>

3의2. 법 제100조의3부터 제100조의5까지의 규정에 따른 연금보험료 지원 및 환수에 관한 사무
4. 법 제108조에 따른 심사청구에 관한 사무
5. 법 제110조 및 제112조에 따른 재심사청구 및 재결에 관한 사무
5의2. 법 제114조에 따른 손해배상청구권 대위에 관한 사무

7. 법 제125조에 따른 소득 축소ㆍ탈루 자료의 통보 등에 관한 사무
The Minister of Health and Welfare and the Corporation (in the case of subparagraph 1, including employment security agencies that have been entrusted with the duties of the Corporation under Article 25-6) may process data containing health information under Article 23 (1) of the Personal Information Protection Act, crime record data under Article 18 (2) of the Enforcement Decree of the same Act, and data containing resident registration numbers, passport numbers, driver's license numbers, or alien registration numbers under Article 19 (1) through (4) of the same Decree, if unavoidable for performing the following duties: <Amended by Act No. 11831, Jun. 29, 2012; Act No. 13389, Jun. 30, 2015; Act No. 14445, Nov. 29, 2016; Act No. 17404, Jul. 1, 2020; Act No. 17964, Jun. 29, 2021> 1. Duties related to the receipt and processing of applications for additional crediting of subscription periods for unemployment under Article 19-2 of this Act. 1-2. Duties related to work under Article 25 of this Act. 2. Duties related to the recovery of benefits and the notification, demand, and disposition of arrears of recovered amounts under Articles 57 and 57-2 of this Act. 3. Duties related to the approval of disposition of arrears of pension insurance premiums, etc. under Article 95 (4) of this Act. 3-2. Duties related to the support and recovery of pension insurance premiums under Articles 100-3 through 100-5 of this Act. 4. Duties related to examination appeals under Article 108 of this Act. 5. Duties related to re-examination appeals and decisions under Articles 110 and 112 of this Act. 5-2. Duties related to subrogation of the right to claim damages under Article 114 of this Act. 6. Duties related to investigations, inquiries, and requests for data, etc. under Articles 122 and 123 of this Act. 7. Duties related to the notification of data on income reduction or omission, etc. under Article 125 of this Act.
건강보험공단(제4호의 경우에는 법 제95조제6항에 따라 건강보험공단의 업무를 대행하는 한국자산관리공사를 포함한다)은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 제1항 각 호 외의 부분에 따른 개인정보가 포함된 자료를 처리할 수 있다. <개정 2019.6.11>
1. 법 제17조제3항에 따른 체납 사실 통지 등에 관한 사무
2. 법 제88조제2항에 따른 연금보험료의 징수에 관한 사무
3. 법 제88조의2 및 제89조에 따른 연금보험료의 납입 고지 및 납부 기한 연장 등에 관한 사무
4. 법 제95조에 따른 연금보험료 등의 독촉 및 체납처분에 관한 사무
5. 법 제97조에 따른 연체금의 징수에 관한 사무
6. 법 제100조제2항에 따른 과오납금의 지급 등에 관한 사무
7. 법 제108조에 따른 심사청구에 관한 사무
8. 법 제118조제2항에 따른 연금보험료의 납부, 징수권 소멸 사항 등의 기록ㆍ보관 및 제공에 관한 사무
The National Health Insurance Service (in the case of subparagraph 4, including the Korea Asset Management Corporation that acts on behalf of the National Health Insurance Service under Article 95 (6) of this Act) may process data containing personal information other than those specified in each subparagraph of paragraph ①, if unavoidable for performing the following duties: <Amended by Act No. 16871, Jun. 11, 2019> 1. Duties related to the notification of arrears, etc. under Article 17 (3) of this Act. 2. Duties related to the collection of pension insurance premiums under Article 88 (2) of this Act. 3. Duties related to the notification of payment and extension of the payment deadline for pension insurance premiums, etc. under Articles 88-2 and 89 of this Act. 4. Duties related to the demand and disposition of arrears of pension insurance premiums, etc. under Article 95 of this Act. 5. Duties related to the collection of late fees under Article 97 of this Act. 6. Duties related to the payment of overpaid and underpaid amounts, etc. under Article 100 (2) of this Act. 7. Duties related to examination appeals under Article 108 of this Act. 8. Duties related to the recording, storage, and provision of information on payment of pension insurance premiums, extinction of the right to collect, etc. under Article 118 (2) of this Act.
법 제47조에 따라 공단으로부터 업무를 위탁받은 자는 제33조에 따른 위탁 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법 시행령」 제19조제1호, 제2호 또는 제4호에 따른 주민등록번호, 여권번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다.
A person entrusted with duties by the Corporation under Article 47 of this Act may process data containing resident registration numbers, passport numbers, or alien registration numbers under Article 19 (1), (2), or (4) of the Enforcement Decree of the Personal Information Protection Act, if unavoidable for performing the entrusted duties under Article 33 of this Act.
법 제123조제1항 및 제2항에 따라 보건복지부장관 및 공단으로부터 자료 제공을 요청받은 국가, 지방자치단체, 그 밖의 공공단체 등은 그 자료제공을 위하여 불가피한 경우 제1항 각 호 외의 부분에 따른 개인정보가 포함된 자료를 처리할 수 있다. <개정 2016.11.29>
