제40조 미지급급여의 지급 방법

1. 같은 순위자 중 1명이 한 청구는 그가 지급받을 부분에 대하여 청구한 것으로 본다.
2. 같은 순위자나 그의 법정대리인이 같은 순위자 전부 또는 일부의 급여를 지급받을 대표자를 선정하면 그 대표자가 같은 순위자 전부 또는 일부에 해당하는 미지급급여를 청구할 수 있다.
① Where there are two or more persons of the same priority entitled to receive unpaid benefits pursuant to Article 55(2) of the Act, the method of payment shall be as follows. <Amended on December 8, 2011> 1. A claim made by one person of the same priority shall be deemed a claim for the portion he or she is to receive. 2. If persons of the same priority or their legal representatives select a representative to receive benefits for all or part of the persons of the same priority, that representative may claim the unpaid benefits corresponding to all or part of the persons of the same priority.
