Article 42 (Interest to be Added Upon Recovery of Benefits)
제42조 급여의 환수 시 가산할 이자

법 제57조제2항 본문에 따라 가산할 이자의 계산 기간은 해당 급여를 지급받은 날이 속하는 달부터 환수금을 고지한 날이 속하는 달의 전달까지의 개월 수에 의하되, 연 단위로 계산한 이자를 지급받은 급여에 산입하여 그 후의 이자액을 계산한다. <개정 2012.6.29>
The calculation period for interest to be added according to the main clause of Article 57 (2) of the Act shall be based on the number of months from the month in which the date of receipt of the benefit falls to the month preceding the month in which the notice of recovery is issued, and the interest calculated on an annual basis shall be included in the benefit received, and the subsequent interest amount shall be calculated. <Amended by Act No. 11797, Jun. 29, 2012>
제1항의 계산 기간에 적용할 이자율은 다음 각 호의 구분에 따른다. <개정 2012.6.29>
1. 법 제57조제1항제1호의 경우: 3년 만기 정기예금 이자율
2. 법 제57조제1항제2호의 경우: 1년 만기 정기예금 이자율
