제49조의2 유족연금의 지급 정지

법 제76조제9항에서 "유족연금 수급권자가 1년 이상 소재불명이고 제2항 및 제3항에 따른 지급 정지의 신청을 할 사람이 존재하지 아니하는 등 대통령령으로 정하는 경우"란 다음 각 호의 경우를 말한다.
1. 유족연금의 수급권자인 배우자의 소재를 1년 이상 알 수 없는 경우로서 법 제76조제2항에 따른 지급 정지 신청을 할 수 있는 유족인 자녀가 없거나 자녀가 지급 정지 신청을 하지 않는 경우
2. 유족연금의 수급권자인 배우자 외의 사람이 2명 이상이고 그 일부 또는 모두의 소재를 1년 이상 알 수 없는 경우로서 법 제76조제3항에 따른 지급 정지 신청을 할 수 있는 사람이 없거나 다른 수급권자가 지급 정지 신청을 하지 않는 경우
3. 유족연금의 수급권자인 배우자 외의 사람이 1명이고 그 사람의 소재를 1년 이상 알 수 없는 경우
The phrase "in cases prescribed by Presidential Decree, such as when a survivor's pension beneficiary is unknown for one year or more and no person exists to apply for suspension of payment under paragraphs (2) and (3) of Article 76 of the Act" refers to the following cases. 1. When the spouse, who is the survivor's pension beneficiary, is unknown for one year or more, and there are no children who can apply for suspension of payment under Article 76 (2) of the Act, or the children do not apply for suspension of payment. 2. When there are two or more persons other than the spouse who are survivor's pension beneficiaries, and the whereabouts of some or all of them are unknown for one year or more, and there is no person who can apply for suspension of payment under Article 76 (3) of the Act, or other beneficiaries do not apply for suspension of payment. 3. When there is one person other than the spouse who is a survivor's pension beneficiary, and the whereabouts of that person are unknown for one year or more.
법 제76조제9항에 따른 유족연금의 지급 정지 절차에 관하여는 제56조의2제1항 및 제2항을 준용한다.
The procedure for suspension of survivor's pension payment under Article 76 (9) of the Act shall be applied mutatis mutandis to paragraphs (1) and (2) of Article 56-2.
