제56조의2 소재불명자에 대한 지급의 정지 등

공단은 법 제86조의2제1항에 따라 급여의 지급을 정지하려는 경우에는 수급권자의 소재불명 여부를 확인해야 한다. 다만, 법 제122조에 따른 조사ㆍ질문 또는 제122조의2에 따른 확인조사 결과 수급권자의 소재불명이 확인된 경우에는 그렇지 않다.
The Corporation shall verify whether a beneficiary is unidentifiable when intending to suspend the payment of benefits pursuant to Article 86-2 (1) of the Act. However, this shall not apply if the beneficiary's unidentifiability is confirmed as a result of an investigation or inquiry under Article 122 or a verification investigation under Article 122-2 of the Act.
공단은 제1항에 따라 수급권자의 소재불명이 확인된 경우에는 10일 이상의 기한을 정하여 소재불명 사실을 해소할 것과 해소되지 않을 경우 급여 지급이 정지된다는 내용이 기재된 통지서를 그 수급권자의 주민등록표에 기재된 마지막 주소 등으로 발송해야 하고, 발송이 불가능한 경우에는 공단의 게시판이나 인터넷 홈페이지에 그 내용을 공고해야 한다.
If the Corporation confirms that a beneficiary is unidentifiable pursuant to paragraph ①, it shall send a notice stating that the fact of unidentifiability must be resolved within a period of not less than 10 days, and that benefits will be suspended if not resolved, to the last address registered on the beneficiary's resident registration card, etc. If sending such a notice is impossible, the Corporation shall publicly announce the contents on its bulletin board or internet homepage.
공단은 법 제86조의2제3항에 따라 수급권자가 사망한 사실이 확인되어 지급 정지를 취소한 경우에는 지급 정지 기간 동안 지급되지 않은 급여를 법 제55조에 따라 지급해야 한다.
If the Corporation cancels the suspension of payment due to confirmation of the beneficiary's death pursuant to Article 86-2 (3) of the Act, it shall pay the benefits that were not paid during the suspension period in accordance with Article 55 of the Act.
