제122조 조사ㆍ질문 등

공단은 가입자의 자격, 기준소득월액, 연금보험료 또는 급여에 관한 결정 등이나 수급권 또는 급여의 발생ㆍ변경ㆍ소멸ㆍ정지 등에 관한 확인을 위하여 필요하다고 인정하면 사용자, 가입자, 가입자였던 자 또는 수급권자에게 필요한 서류나 그 밖의 소득ㆍ재산 등에 관한 자료를 제출하도록 요구하거나 소속 직원으로 하여금 사업장이나 그 밖의 필요한 장소에 방문하여 서류 등을 조사하거나 관계인에게 필요한 질문을 하게 할 수 있다. <개정 2015.12.29>
Where the Corporation deems it necessary for the confirmation of the eligibility of subscribers, standard monthly income amount, pension premiums, or benefit determinations, or for the confirmation of entitlement to benefits or the occurrence, change, extinction, or suspension of benefits, etc., it may request the employer, subscriber, former subscriber, or beneficiary to submit necessary documents or other materials concerning income or assets, etc., or may have its employees visit workplaces or other necessary places to investigate documents, etc., or ask necessary questions to the persons concerned.
제1항에 따라 방문ㆍ조사ㆍ질문하는 공단 직원은 그 권한을 표시하는 증표 및 조사기간, 조사범위, 조사담당자, 관계 법령 등 보건복지부령으로 정하는 사항이 기재된 서류를 지니고 이를 관계인에게 내보여야 한다. <개정 2015.12.29>
Employees of the Corporation who visit and conduct investigations or ask questions under paragraph ① shall carry and present to the persons concerned an identification card indicating their authority, and a document stating details such as the investigation period, scope of investigation, investigator, and relevant laws and regulations as prescribed by the Ordinance of the Ministry of Health and Welfare.
제1항에 따른 조사 또는 질문의 내용ㆍ절차ㆍ방법 등에 관하여는 이 법에서 정하는 사항을 제외하고는 「행정조사기본법」에서 정하는 바에 따른다. <신설 2015.12.29>
Matters concerning the content, procedures, and methods of investigations or questioning under paragraph ① shall be subject to the provisions of the 「Framework Act on Administrative Investigations」, except as otherwise provided in this Act.
