Article 122-2 (Verification Investigation of Beneficiaries)

공단은 수급자 및 수급자에 대한 급여의 적정성을 확인하기 위하여 매년 연간조사계획을 수립하고 수급자의 사망ㆍ이혼ㆍ생계유지 여부 등에 관한 조사를 실시하여야 한다.
The Corporation shall establish an annual investigation plan and conduct investigations regarding the death, divorce, or livelihood of beneficiaries to verify the appropriateness of benefits for beneficiaries.
공단은 제1항에 따른 연간조사계획과 실시 결과를 제41조제1항 및 제2항을 준용하여 보건복지부장관에게 제출하여야 한다.
The Corporation shall submit the annual investigation plan and the results of its implementation under paragraph ① to the Minister of Health and Welfare, applying mutatis mutandis Articles 41(1) and (2).
공단은 수급자, 그 배우자 또는 그 밖의 관계인이 제1항에 따른 조사를 두 번 이상 거부ㆍ방해 또는 기피한 경우에는 수급자에 대한 급여 지급을 정지 또는 중지할 수 있다. 이 경우 서면으로 그 이유를 분명하게 밝혀 수급자에게 통지하여야 한다.
If a beneficiary, their spouse, or any other related person refuses, obstructs, or evades the investigation under paragraph ① two or more times, the Corporation may suspend or cease the payment of benefits to the beneficiary. In this case, the reason shall be clearly stated in writing and notified to the beneficiary.
제1항에 따른 조사의 범위ㆍ방법 및 시기 등에 필요한 사항은 대통령령으로 정한다.
Matters necessary for the scope, method, and timing of the investigation under paragraph ① shall be determined by Presidential Decree.
