제123조 자료의 요청 및 전산망의 이용

보건복지부장관은 국가기관, 지방자치단체, 그 밖에 대통령령으로 정하는 기관ㆍ법인ㆍ단체의 장에게 제100조의3제1항 및 제100조의4제1항에 따른 연금보험료 지원 여부를 확인하기 위하여 필요한 자료로서 대통령령으로 정하는 자료를 요청할 수 있다. 이 경우 국가기관, 지방자치단체, 기관ㆍ법인ㆍ단체의 장은 특별한 사유가 없으면 요청받은 자료를 제공하여야 한다. <신설 2016.5.29, 2020.1.21>
The Minister of Health and Welfare may request data, as prescribed by Presidential Decree, from the heads of national agencies, local governments, and other agencies, corporations, or organizations designated by Presidential Decree, for the purpose of verifying whether to support pension insurance premiums pursuant to Article 100-3(1) and Article 100-4(1). In this case, the heads of national agencies, local governments, agencies, corporations, or organizations shall provide the requested data unless there is a special reason otherwise. <Newly established on May 29, 2016; amended on January 21, 2020>
공단은 국가기관, 지방자치단체, 그 밖에 대통령령으로 정하는 기관ㆍ법인ㆍ단체의 장에게 가입자의 자격 관리, 연금보험료의 부과, 급여의 결정 및 지급 등 국민연금사업과 관련하여 필요한 자료로서 주민등록ㆍ가족관계등록ㆍ국세ㆍ지방세ㆍ토지ㆍ건물ㆍ건강보험ㆍ장애인등록 등 대통령령으로 정하는 자료를 요청할 수 있다. 이 경우 국가기관, 지방자치단체, 기관ㆍ법인ㆍ단체의 장은 특별한 사유가 없으면 요청받은 자료를 제공하여야 한다. <개정 2015.1.28, 2016.5.29>
The Corporation may request data, as prescribed by Presidential Decree, such as resident registration, family relationship registration, national tax, local tax, land, buildings, health insurance, and disability registration, from the heads of national agencies, local governments, and other agencies, corporations, or organizations designated by Presidential Decree, which are necessary in connection with the National Pension service, including management of subscribers' qualifications, imposition of pension insurance premiums, and determination and payment of benefits. In this case, the heads of national agencies, local governments, agencies, corporations, or organizations shall provide the requested data unless there is a special reason otherwise. <Amended on January 28, 2015; May 29, 2016>
공단은 부양가족연금, 장애연금 및 유족연금 급여의 지급심사 시 필요한 경우에는 보건복지부령으로 정하는 바에 따라 가입자 또는 가입자였던 사람(가입자 또는 가입자였던 사람이 사망한 경우 「의료법」 제21조제3항제3호에 따른 친족관계에 있는 사람을 포함한다)으로부터 동의를 받아 「의료법」에 따른 의료기관에 대하여 가입자 또는 가입자였던 사람의 해당 진료에 관한 사항의 열람 또는 사본교부를 요청할 수 있다. 이 경우 요청을 받은 의료기관은 특별한 사유가 없으면 요청에 따라야 한다. <신설 2011.12.31, 2016.5.29, 2016.12.20>
When necessary for the examination of payment of dependent's pension, disability pension, and survivor's pension benefits, the Corporation may, upon obtaining consent from a subscriber or a former subscriber (including a person in a kinship relationship as defined in Article 21(3) 3. of the 「Medical Service Act」 in the case where the subscriber or former subscriber has died), request from a medical institution under the 「Medical Service Act」, access to or a copy of the relevant medical treatment records of the subscriber or former subscriber, as prescribed by the Minister of Health and Welfare. In this case, the medical institution that receives the request shall comply with the request unless there is a special reason otherwise. <Newly established on December 31, 2011; amended on May 29, 2016; December 20, 2016>
보건복지부장관 및 공단은 제1항 및 제2항에 따른 자료의 확인을 위하여 「사회복지사업법」 제6조의2제2항에 따른 정보시스템을 연계하여 사용할 수 있다. <신설 2015.1.28, 2016.5.29>
The Minister of Health and Welfare and the Corporation may link and use the information system pursuant to Article 6-2(2) of the 「Social Welfare Services Act」 to verify the data pursuant to paragraphs (1) and (2). <Newly established on January 28, 2015; May 29, 2016>
