제70조 장애연금액의 변경 등

공단은 장애연금 수급권자의 장애 정도를 심사하여 장애등급이 다르게 되면 그 등급에 따라 장애연금액을 변경하고, 장애등급에 해당되지 아니하면 장애연금 수급권을 소멸시킨다.
The Corporation shall examine the degree of disability of a disability pension beneficiary, and if the disability grade changes, shall change the disability pension amount according to that grade, and if the beneficiary does not fall under any disability grade, shall extinguish the right to receive the disability pension.
장애연금의 수급권자는 그 장애가 악화되면 공단에 장애연금액의 변경을 청구할 수 있다.
A disability pension beneficiary may request a change in the disability pension amount from the Corporation if their disability deteriorates.
제1항 및 제2항에 따라 장애정도를 결정할 때에는 완치일을 기준으로 하며, 다음 각 호의 구분에 따른 날까지 완치되지 않은 경우에는 그 해당하는 날을 기준으로 장애 정도를 결정한다. <신설 2011.12.31, 2016.5.29>
1. 제1항의 경우: 장애 정도의 변화개연성에 따라 공단이 지정한 주기가 도래한 날이 속하는 달의 말일 등 대통령령으로 정하는 날
2. 제2항의 경우: 수급권자가 장애연금액의 변경을 청구한 날
When determining the degree of disability pursuant to paragraphs ① and ②, the date of complete cure shall be the basis, and if not completely cured by the date specified in the following subparagraphs, the degree of disability shall be determined based on the corresponding date. <Newly enacted on Dec. 31, 2011, Amended on May. 29, 2016> 1. In the case of paragraph ①: The last day of the month in which the period designated by the Corporation according to the likelihood of change in the degree of disability arrives, or other dates prescribed by Presidential Decree. 2. In the case of paragraph ②: The date on which the beneficiary requested a change in the disability pension amount.
제1항 및 제2항은 60세 이상인 장애연금 수급권자에 대하여는 적용하지 아니한다. <개정 2011.12.31>
Paragraphs ① and ② shall not apply to disability pension beneficiaries who are 60 years of age or older. <Amended on Dec. 31, 2011>
