Article 75 (Extinction of Survivor's Pension Benefit Right)
제75조 유족연금 수급권의 소멸

유족연금 수급권자가 다음 각 호의 어느 하나에 해당하게 되면 그 수급권은 소멸한다. <개정 2011.12.31, 2016.5.29, 2017.10.24, 2023.6.13>
1. 수급권자가 사망한 때
2. 배우자인 수급권자가 재혼한 때
3. 자녀나 손자녀인 수급권자가 파양된 때
4. 제52조의2에 따른 장애상태에 해당하지 아니한 자녀인 수급권자가 25세가 된 때 또는 제52조의2에 따른 장애상태에 해당하지 아니한 손자녀인 수급권자가 19세가 된 때
5. 삭제<2017.10.24>
If a survivor's pension benefit right holder falls under any of the following subparagraphs, the benefit right shall be extinguished. <Amended by Act No. 11144, Dec. 31, 2011, Act No. 14173, May 29, 2016, Act No. 14999, Oct. 24, 2017, Act No. 19483, June 13, 2023> 1. When the benefit right holder dies 2. When a spouse benefit right holder remarries 3. When a child or grandchild benefit right holder is adopted by another person 4. When a child benefit right holder not falling under the disability status pursuant to Article 52-2 reaches the age of 25, or when a grandchild benefit right holder not falling under the disability status pursuant to Article 52-2 reaches the age of 19 5. 부모, 손자녀 또는 조부모인 유족의 유족연금 수급권은 가입자 또는 가입자였던 사람이 사망할 당시에 그 가입자 또는 가입자였던 사람의 태아가 출생하여 수급권을 갖게 되면 소멸한다. <개정 2015.1.28>
The survivor's pension benefit right of a survivor who is a parent, grandchild, or grandparent shall be extinguished if the fetus of the insured person or former insured person, who is the insured person or former insured person, is born and acquires the benefit right at the time of the death of the insured person or former insured person. <Amended by Act No. 13055, Jan. 28, 2015>
