Article 77 (Lump-sum Severance Payment)
제77조 반환일시금

가입자 또는 가입자였던 자가 다음 각 호의 어느 하나에 해당하게 되면 본인이나 그 유족의 청구에 의하여 반환일시금을 지급받을 수 있다. <개정 2016.5.29>
1. 가입기간이 10년 미만인 자가 60세가 된 때
2. 가입자 또는 가입자였던 자가 사망한 때. 다만, 제72조에 따라 유족연금이 지급되는 경우에는 그러하지 아니하다.
3. 국적을 상실하거나 국외로 이주한 때
A subscriber or a former subscriber may receive a lump-sum severance payment upon application by himself/herself or his/her survivor if he/she falls under any of the following subparagraphs. <Amended by Act No. 13713, May 29, 2016> 1. When a person whose subscription period is less than 10 years reaches 60 years of age 2. When a subscriber or a former subscriber dies. However, this shall not apply if a survivor's pension is paid under Article 72. 3. When nationality is lost or when moving abroad
제1항에 따른 반환일시금의 액수는 가입자 또는 가입자였던 자가 납부한 연금보험료(사업장가입자 또는 사업장가입자였던 자의 경우에는 사용자의 부담금을 포함한다)에 대통령령으로 정하는 이자를 더한 금액으로 한다.
The amount of the lump-sum severance payment under paragraph ① shall be the sum of the pension insurance premiums paid by the subscriber or former subscriber (including contributions by the employer in the case of an insured worker or a former insured worker), plus interest as prescribed by a Presidential Decree.
제1항에 따라 반환일시금의 지급을 청구할 경우 유족의 범위와 청구의 우선순위 등에 관하여는 제73조를 준용한다.
When claiming the lump-sum severance payment under paragraph ①, the scope of survivors and the order of claims shall be applied mutatis mutandis to Article 73.
