제97조의2 고액ㆍ상습 체납자의 인적사항 공개

건강보험공단은 이 법에 따른 납부기한의 다음 날부터 1년이 지난 연금보험료, 연체금 및 체납처분비(이하 이 항에서 "연금보험료등"이라 한다)의 총액이 2천만원 이상인 체납자(사업장가입자에 한한다)가 납부능력이 있음에도 불구하고 체납한 경우 체납자의 인적사항(사용자의 인적사항을 말한다) 및 체납액 등(이하 이 조에서 "인적사항등"이라 한다)을 공개할 수 있다. 다만, 체납된 연금보험료등과 관련하여 행정심판 또는 행정소송이 계류 중인 경우나 그 밖에 체납된 금액의 일부 납부 등 대통령령으로 정하는 사유가 있는 경우에는 그러하지 아니하다. <개정 2020.12.29>
The National Health Insurance Service may disclose the personal information (referring to the personal information of the employer) and the amount of delinquency, etc. (hereinafter referred to as “personal information, etc.” in this Article) of a delinquent (limited to those who are enrolled as an employer subscriber) whose total amount of pension insurance premiums, late fees, and delinquent disposition costs (hereinafter referred to as “pension insurance premiums, etc.” in this Paragraph) due for more than one year from the day following the payment deadline under this Act is 20 million won or more, and who has defaulted despite having the ability to pay. However, this shall not apply if an administrative appeal or administrative litigation related to the delinquent pension insurance premiums, etc. is pending, or for other reasons prescribed by Presidential Decree, such as partial payment of the delinquent amount.
인적사항등에 대한 공개 여부를 심의하기 위하여 건강보험공단에 보험료정보공개심의위원회를 둔다.
A Premium Information Disclosure Deliberation Committee shall be established within the National Health Insurance Service to deliberate on whether to disclose personal information, etc.
건강보험공단은 보험료정보공개심의위원회의 심의를 거친 인적사항등의 공개대상자에게 공개대상자임을 서면으로 통지하여 소명의 기회를 부여하여야 하며, 통지일부터 6개월이 경과한 후 체납액의 납부 이행 등을 고려하여 공개대상자를 선정한다.
The National Health Insurance Service shall notify the person subject to disclosure of personal information, etc. in writing, after deliberation by the Premium Information Disclosure Deliberation Committee, to grant an opportunity for explanation, and shall select the person subject to disclosure after considering the payment of the delinquent amount, etc. after the lapse of 6 months from the date of notification.
인적사항등의 공개는 관보에 게재하거나 건강보험공단 인터넷 홈페이지에 게시하는 방법으로 한다.
The disclosure of personal information, etc. shall be made by publishing it in the Official Gazette or posting it on the National Health Insurance Service’s internet homepage.
인적사항등의 공개와 관련한 납부능력의 기준, 체납액의 납부 이행, 공개절차 및 보험료정보공개심의위원회의 구성ㆍ운영 등은 대통령령으로 정한다.
