제15조 외국 국적 취득에 따른 국적 상실

대한민국의 국민으로서 자진하여 외국 국적을 취득한 자는 그 외국 국적을 취득한 때에 대한민국 국적을 상실한다.
A person who, as a national of the Republic of Korea, voluntarily acquires foreign nationality shall lose the nationality of the Republic of Korea at the time of acquiring such foreign nationality.
대한민국의 국민으로서 다음 각 호의 어느 하나에 해당하는 자는 그 외국 국적을 취득한 때부터 6개월 내에 법무부장관에게 대한민국 국적을 보유할 의사가 있다는 뜻을 신고하지 아니하면 그 외국 국적을 취득한 때로 소급(遡及)하여 대한민국 국적을 상실한 것으로 본다.
1. 외국인과의 혼인으로 그 배우자의 국적을 취득하게 된 자
2. 외국인에게 입양되어 그 양부 또는 양모의 국적을 취득하게 된 자
3. 외국인인 부 또는 모에게 인지되어 그 부 또는 모의 국적을 취득하게 된 자
4. 외국 국적을 취득하여 대한민국 국적을 상실하게 된 자의 배우자나 미성년의 자(子)로서 그 외국의 법률에 따라 함께 그 외국 국적을 취득하게 된 자
A national of the Republic of Korea falling under any of the following subparagraphs shall be deemed to have lost the nationality of the Republic of Korea retroactively to the time of acquiring foreign nationality, unless he/she reports his/her intention to retain the nationality of the Republic of Korea to the Minister of Justice within six months from the time of acquiring such foreign nationality: 1. A person who has acquired the nationality of the foreign spouse due to marriage with a foreigner. 2. A person who has acquired the nationality of the adoptive parent due to adoption by a foreigner. 3. A person who has acquired the nationality of the foreign parent due to acknowledgment by a foreign father or mother. 4. A spouse or minor child of a person who has lost the nationality of the Republic of Korea due to the acquisition of foreign nationality, who has acquired the foreign nationality together according to the laws of that foreign country.
외국 국적을 취득함으로써 대한민국 국적을 상실하게 된 자에 대하여 그 외국 국적의 취득일을 알 수 없으면 그가 사용하는 외국 여권의 최초 발급일에 그 외국 국적을 취득한 것으로 추정한다.
If the date of acquisition of foreign nationality cannot be ascertained for a person who has lost the nationality of the Republic of Korea due to the acquisition of foreign nationality, it shall be presumed that such person acquired the foreign nationality on the date of the first issuance of his/her foreign passport.
제2항에 따른 신고 절차와 그 밖에 필요한 사항은 대통령령으로 정한다.
The reporting procedures under Paragraph (2) and other necessary matters shall be prescribed by Presidential Decree.
