대한민국 국적을 취득한 사실이 없는 외국인은 법무부장관의 귀화허가(歸化許可)를 받아 대한민국 국적을 취득할 수 있다.
A foreigner who has not acquired nationality of the Republic of Korea may acquire nationality of the Republic of Korea by receiving naturalization permission (歸化許可) from the Minister of Justice.
법무부장관은 귀화허가 신청을 받으면 제5조부터 제7조까지의 귀화 요건을 갖추었는지를 심사한 후 그 요건을 갖춘 사람에게만 귀화를 허가한다. <개정 2017.12.19>
Upon receiving an application for naturalization permission, the Minister of Justice shall review whether the applicant meets the naturalization requirements prescribed in Articles 5 to 7, and shall grant naturalization only to those who meet such requirements. <Amended by Act No. 15234, Dec. 19, 2017>
제1항에 따라 귀화허가를 받은 사람은 법무부장관 앞에서 국민선서를 하고 귀화증서를 수여받은 때에 대한민국 국적을 취득한다. 다만, 법무부장관은 연령, 신체적ㆍ정신적 장애 등으로 국민선서의 의미를 이해할 수 없거나 이해한 것을 표현할 수 없다고 인정되는 사람에게는 국민선서를 면제할 수 있다. <개정 2017.12.19>
A person who has received naturalization permission pursuant to paragraph ① shall acquire nationality of the Republic of Korea upon taking the oath of allegiance before the Minister of Justice and receiving a naturalization certificate. Provided, That the Minister of Justice may exempt from the oath of allegiance any person who, due to age, physical or mental disability, etc., is deemed unable to understand the meaning of the oath of allegiance or to express what has been understood.
법무부장관은 제3항 본문에 따른 국민선서를 받고 귀화증서를 수여하는 업무와 같은 항 단서에 따른 국민선서의 면제 업무를 대통령령으로 정하는 바에 따라 지방출입국ㆍ외국인관서의 장에게 대행하게 할 수 있다. <신설 2017.12.19>
The Minister of Justice may, in accordance with the Presidential Decree, delegate the duties of administering the oath of allegiance and issuing the naturalization certificate under the main sentence of paragraph ③, and the duties of exempting from the oath of allegiance under the proviso of the same paragraph, to the head of an immigration office. <Newly Inserted by Act No. 15234, Dec. 19, 2017>
제1항부터 제4항까지에 따른 신청절차, 심사, 국민선서 및 귀화증서 수여와 그 대행 등에 관하여 필요한 사항은 대통령령으로 정한다. <개정 2017.12.19>
