Article 109 (Investigation of Hazards and Risks of Chemicals with a Risk of Serious Health Impairment)
제109조 중대한 건강장해 우려 화학물질의 유해성ㆍ위험성 조사

고용노동부장관은 근로자의 건강장해를 예방하기 위하여 필요하다고 인정할 때에는 고용노동부령으로 정하는 바에 따라 암 또는 그 밖에 중대한 건강장해를 일으킬 우려가 있는 화학물질을 제조ㆍ수입하는 자 또는 사용하는 사업주에게 해당 화학물질의 유해성ㆍ위험성 조사와 그 결과의 제출 또는 제105조제1항에 따른 유해성ㆍ위험성 평가에 필요한 자료의 제출을 명할 수 있다.
When the Minister of Employment and Labor deems it necessary to prevent occupational health impairment, he/she may, as prescribed by the Ordinance of the Ministry of Employment and Labor, order a manufacturer or importer of chemical substances that may cause cancer or other serious health impairment, or an employer using such chemical substances, to investigate the hazards and risks of the relevant chemical substances and submit the results, or to submit data necessary for the hazard and risk assessment under Article 105 (1).
제1항에 따라 화학물질의 유해성ㆍ위험성 조사 명령을 받은 자는 유해성ㆍ위험성 조사 결과 해당 화학물질로 인한 근로자의 건강장해가 우려되는 경우 근로자의 건강장해를 예방하기 위하여 시설ㆍ설비의 설치 또는 개선 등 필요한 조치를 하여야 한다.
A person who has received an order to investigate the hazards and risks of chemical substances pursuant to paragraph ① shall take necessary measures, such as installing or improving facilities and equipment, to prevent occupational health impairment if the investigation of hazards and risks reveals a concern of health impairment of workers due to the relevant chemical substances.
고용노동부장관은 제1항에 따라 제출된 조사 결과 및 자료를 검토하여 근로자의 건강장해를 예방하기 위하여 필요하다고 인정하는 경우에는 해당 화학물질을 제105조제2항에 따라 구분하여 관리하거나 해당 화학물질을 제조ㆍ수입한 자 또는 사용하는 사업주에게 근로자의 건강장해 예방을 위한 시설ㆍ설비의 설치 또는 개선 등 필요한 조치를 하도록 명할 수 있다.
When the Minister of Employment and Labor reviews the investigation results and data submitted pursuant to paragraph ① and deems it necessary to prevent occupational health impairment, he/she may classify and manage the relevant chemical substances according to Article 105 (2) or order the manufacturer or importer of the relevant chemical substances or the employer using them to take necessary measures, such as installing or improving facilities and equipment, to prevent occupational health impairment of workers.
