Article 138 (Prohibition or Restriction of Work for Persons with Illnesses)
제138조 질병자의 근로 금지ㆍ제한

사업주는 감염병, 정신질환 또는 근로로 인하여 병세가 크게 악화될 우려가 있는 질병으로서 고용노동부령으로 정하는 질병에 걸린 사람에게는 「의료법」 제2조에 따른 의사의 진단에 따라 근로를 금지하거나 제한하여야 한다.
An employer shall, in accordance with a doctor's diagnosis under Article 2 of the 「Medical Service Act」, prohibit or restrict work for a person who has contracted an infectious disease, a mental illness, or an illness where there is a significant risk of exacerbation due to work, as prescribed by the Ordinance of the Ministry of Employment and Labor.
사업주는 제1항에 따라 근로가 금지되거나 제한된 근로자가 건강을 회복하였을 때에는 지체 없이 근로를 할 수 있도록 하여야 한다.
An employer shall, without delay, allow a worker whose work has been prohibited or restricted under paragraph ① to resume work once their health has been restored.
