제159조 영업정지의 요청 등

고용노동부장관은 사업주가 다음 각 호의 어느 하나에 해당하는 산업재해를 발생시킨 경우에는 관계 행정기관의 장에게 관계 법령에 따라 해당 사업의 영업정지나 그 밖의 제재를 할 것을 요청하거나 「공공기관의 운영에 관한 법률」 제4조에 따른 공공기관의 장에게 그 기관이 시행하는 사업의 발주 시 필요한 제한을 해당 사업자에게 할 것을 요청할 수 있다.
1. 제38조, 제39조 또는 제63조를 위반하여 많은 근로자가 사망하거나 사업장 인근지역에 중대한 피해를 주는 등 대통령령으로 정하는 사고가 발생한 경우
2. 제53조제1항 또는 제3항에 따른 명령을 위반하여 근로자가 업무로 인하여 사망한 경우
The Minister of Employment and Labor, when an employer causes an industrial accident falling under any of the following subparagraphs, may request the head of the relevant administrative agency to suspend the business or impose other sanctions on the relevant business in accordance with related laws and regulations, or may request the head of a public institution under Article 4 of the 「Act on the Management of Public Institutions」 to impose necessary restrictions on the business operator when issuing orders for projects implemented by that institution. 1. When an accident occurs, as prescribed by Presidential Decree, such as the death of many workers or serious damage to areas near the workplace, in violation of Article 38, 39, or 63 2. When a worker dies due to work in violation of an order under Article 53 (1) or (3)
제1항에 따라 요청을 받은 관계 행정기관의 장 또는 공공기관의 장은 정당한 사유가 없으면 이에 따라야 하며, 그 조치 결과를 고용노동부장관에게 통보하여야 한다.
The head of the relevant administrative agency or the head of a public institution who receives a request under paragraph (1) shall comply therewith unless there is a justifiable reason, and shall notify the Minister of Employment and Labor of the results of the measures.
제1항에 따른 영업정지 등의 요청 절차나 그 밖에 필요한 사항은 고용노동부령으로 정한다.
The procedures for requesting suspension of business, etc. under paragraph (1) or other necessary matters shall be determined by the Minister of Employment and Labor Ordinance.
