제77조 특수형태근로종사자에 대한 안전조치 및 보건조치 등

계약의 형식에 관계없이 근로자와 유사하게 노무를 제공하여 업무상의 재해로부터 보호할 필요가 있음에도 「근로기준법」 등이 적용되지 아니하는 사람으로서 다음 각 호의 요건을 모두 충족하는 사람(이하 "특수형태근로종사자"라 한다)의 노무를 제공받는 자는 특수형태근로종사자의 산업재해 예방을 위하여 필요한 안전조치 및 보건조치를 하여야 한다. <개정 2020.5.26>
1. 대통령령으로 정하는 직종에 종사할 것
2. 주로 하나의 사업에 노무를 상시적으로 제공하고 보수를 받아 생활할 것
3. 노무를 제공할 때 타인을 사용하지 아니할 것
A person who receives labor from individuals who provide labor similar to that of employees, regardless of the form of the contract, and who needs to be protected from occupational accidents, but to whom the 「Labor Standards Act」, etc. does not apply, and who satisfies all of the following requirements (hereinafter referred to as "workers in special types of employment"), shall take necessary safety and health measures for the prevention of industrial accidents for workers in special types of employment. <Amended by Act No. 17257, May 26, 2020> 1. Engaged in a job category prescribed by Presidential Decree 2. Primarily and constantly provides labor to one business and receives remuneration for living 3. Does not use others when providing labor
대통령령으로 정하는 특수형태근로종사자로부터 노무를 제공받는 자는 고용노동부령으로 정하는 바에 따라 안전 및 보건에 관한 교육을 실시하여야 한다.
A person who receives labor from workers in special types of employment prescribed by Presidential Decree shall provide education on safety and health in accordance with the Ministry of Employment and Labor regulations.
정부는 특수형태근로종사자의 안전 및 보건의 유지ㆍ증진에 사용하는 비용의 일부 또는 전부를 지원할 수 있다.
The Government may support all or part of the expenses used for maintaining and promoting the safety and health of workers in special types of employment.
