Article 6-2 (Reporting of Housing Lease Agreements)
제6조의2 주택 임대차 계약의 신고

임대차계약당사자는 주택(「주택임대차보호법」 제2조에 따른 주택을 말하며, 주택을 취득할 수 있는 권리를 포함한다. 이하 같다)에 대하여 대통령령으로 정하는 금액을 초과하는 임대차 계약을 체결한 경우 그 보증금 또는 차임 등 국토교통부령으로 정하는 사항을 임대차 계약의 체결일부터 30일 이내에 주택 소재지를 관할하는 신고관청에 공동으로 신고하여야 한다. 다만, 임대차계약당사자 중 일방이 국가등인 경우에는 국가등이 신고하여야 한다.
Where parties to a lease agreement enter into a lease agreement concerning a house (hereinafter referred to as a “house” in this Article, meaning a house under Article 2 of the 「Housing Lease Protection Act」, and including rights to acquire a house), where the deposit or rent exceeds the amount prescribed by Presidential Decree, they shall jointly report the deposit, rent, and other matters prescribed by Ordinance of the Ministry of Land, Infrastructure and Transport to the reporting authority having jurisdiction over the location of the house within 30 days from the date of entering into the lease agreement. However, if one of the parties to the lease agreement is the State, etc., the State, etc. shall report.
제1항에 따른 주택 임대차 계약의 신고는 임차가구 현황 등을 고려하여 대통령령으로 정하는 지역에 적용한다.
The reporting of housing lease agreements under paragraph ① shall apply to areas prescribed by Presidential Decree, taking into account the status of tenant households, etc.
제1항에도 불구하고 임대차계약당사자 중 일방이 신고를 거부하는 경우에는 국토교통부령으로 정하는 바에 따라 단독으로 신고할 수 있다.
Notwithstanding paragraph ①, if one of the parties to the lease agreement refuses to report, the other party may report individually in accordance with the provisions of the Ordinance of the Ministry of Land, Infrastructure and Transport.
제1항에 따라 신고를 받은 신고관청은 그 신고 내용을 확인한 후 신고인에게 신고필증을 지체 없이 발급하여야 한다.
Upon receiving a report under paragraph ①, the reporting authority shall, after confirming the contents of the report, promptly issue a reporting certificate to the reporter.
신고관청은 제1항부터 제4항까지의 규정에 따른 사무에 대한 해당 권한의 일부를 그 지방자치단체의 조례로 정하는 바에 따라 읍ㆍ면ㆍ동장 또는 출장소장에게 위임할 수 있다.
The reporting authority may delegate a part of the authority concerning the matters under paragraphs ① through ④ to the head of an eup, myeon, or dong, or the head of a branch office, in accordance with the ordinances of the local government.
제1항, 제3항 또는 제4항에 따른 신고 및 신고필증 발급의 절차와 그 밖에 필요한 사항은 국토교통부령으로 정한다.
The procedures for reporting and issuing reporting certificates under paragraphs ①, ③, or ④, and other necessary matters shall be prescribed by Ordinance of the Ministry of Land, Infrastructure and Transport.
