Article 102 (Disqualifications for Academy Registration, etc.)
제102조 학원 등록 등의 결격사유

다음 각 호의 어느 하나에 해당하는 사람은 제99조에 따른 학원의 등록을 할 수 없다. <개정 2015.8.11>
1. 피성년후견인
2. 파산선고를 받고 복권되지 아니한 사람
3. 금고 이상의 형을 선고받고 그 집행이 끝나거나 집행을 받지 아니하기로 확정된 후 3년이 지나지 아니한 사람 또는 금고 이상의 형을 선고받고 그 집행유예기간 중에 있는 사람
4. 법원의 판결에 의하여 자격이 정지 또는 상실된 사람
5. 제113조제1항제1호, 제5호부터 제12호까지, 같은 조 제2항 및 제4항에 따라 그 등록이 취소된 날부터 1년이 지나지 아니한 학원의 설립ㆍ운영자 또는 학원의 등록이 취소된 날부터 1년 이내에 같은 장소에서 학원을 설립ㆍ운영하려는 사람
6. 임원 중에 제1호부터 제5호까지 중 어느 하나에 해당하는 사람이 있는 법인
A person falling under any of the following subparagraphs shall not be registered as an academy pursuant to Article 99. <Amended by Act No. 13447, Aug. 11, 2015> 1. A person under adult guardianship. 2. A person who has been declared bankrupt and has not been reinstated. 3. A person who has been sentenced to imprisonment or a heavier punishment and for whom three years have not elapsed since the execution thereof was completed or determined to be unexecuted, or a person who has been sentenced to imprisonment or a heavier punishment and is within the period of suspension of execution thereof. 4. A person whose qualifications have been suspended or forfeited by a court judgment. 5. A founder or operator of an academy whose registration has been canceled pursuant to Article 113 (1) subparagraphs 1, and 5 through 12, and paragraphs (2) and (4) of the same Article, and for whom one year has not elapsed since the date of cancellation, or a person who intends to establish or operate an academy at the same location within one year from the date of cancellation of the academy's registration. 6. A corporation whose executive officer falls under any of subparagraphs 1 through 5.
학원을 설립ㆍ운영하는 자가 제1항 각 호의 어느 하나에 해당하게 된 경우에는 그 등록은 효력을 잃는다. 다만, 제1항제6호에 해당하는 경우로서 법인의 임원 중에 그 사유에 해당하는 사람이 있더라도 그 사유가 발생한 날부터 3개월 이내에 그 임원을 해임하거나 다른 사람으로 바꾸어 임명한 경우에는 그러하지 아니하다.
If a person establishing or operating an academy falls under any of the subparagraphs of paragraph (1), the registration shall lose its effect. Provided, however, that in cases falling under subparagraph (1) 6, if the executive officer who falls under such cause is dismissed or replaced within three months from the date the cause occurred, this shall not apply.
