제12조의2 노인 및 장애인 보호구역의 지정ㆍ해제 및 관리

시장등은 교통사고의 위험으로부터 노인 또는 장애인을 보호하기 위하여 필요하다고 인정하는 경우에는 제1호부터 제3호까지 및 제3호의2에 따른 시설 또는 장소의 주변도로 가운데 일정 구간을 노인 보호구역으로, 제4호에 따른 시설의 주변도로 가운데 일정 구간을 장애인 보호구역으로 각각 지정하여 차마와 노면전차의 통행을 제한하거나 금지하는 등 필요한 조치를 할 수 있다. <개정 2013.3.23, 2014.11.19, 2017.7.26, 2018.3.27, 2021.10.19, 2023.1.3>
1. 「노인복지법」 제31조에 따른 노인복지시설
2. 「자연공원법」 제2조제1호에 따른 자연공원 또는 「도시공원 및 녹지 등에 관한 법률」 제2조제3호에 따른 도시공원
3. 「체육시설의 설치ㆍ이용에 관한 법률」 제6조에 따른 생활체육시설
3의2. 그 밖에 노인이 자주 왕래하는 곳으로서 조례로 정하는 시설 또는 장소
4. 「장애인복지법」 제58조에 따른 장애인복지시설
A mayor, etc., when deemed necessary to protect senior citizens or persons with disabilities from the risk of traffic accidents, may designate a certain section of the road surrounding facilities or places referred to in subparagraphs 1 through 3 and 3-2 as a senior citizen protection zone, and a certain section of the road surrounding facilities referred to in subparagraph 4 as a disability protection zone, and may take necessary measures such as restricting or prohibiting the passage of vehicles and trams. <Amended by Act No. 11729, Mar. 23, 2013; Act No. 12844, Nov. 19, 2014; Act No. 14851, Jul. 26, 2017; Act No. 15530, Mar. 27, 2018; Act No. 18574, Oct. 19, 2021; Act No. 19470, Jan. 3, 2023> 1. Senior citizen welfare facilities under Article 31 of the Senior Welfare Act 2. National parks under Article 2(1) of the National Park Act or urban parks under Article 2(3) of the Act on Urban Parks, Green Spaces, etc. 3. Lifestyle sports facilities under Article 6 of the Act on the Establishment and Use of Sports Facilities 3-2. Other facilities or places where senior citizens frequently visit, as determined by ordinance 4. Disability welfare facilities under Article 58 of the Act on the Welfare of Persons with Disabilities
제1항에 따른 노인 보호구역 또는 장애인 보호구역의 지정ㆍ해제 절차 및 기준 등에 관하여 필요한 사항은 행정안전부, 보건복지부 및 국토교통부의 공동부령으로 정한다. <개정 2013.3.23, 2014.11.19, 2017.7.26, 2023.4.18>
Necessary matters concerning the procedures and standards for the designation and abolition of senior citizen protection zones or disability protection zones under paragraph ① shall be prescribed by a joint ordinance of the Ministry of the Interior and Safety, the Ministry of Health and Welfare, and the Ministry of Land, Infrastructure and Transport. <Amended by Act No. 11729, Mar. 23, 2013; Act No. 12844, Nov. 19, 2014; Act No. 14851, Jul. 26, 2017; Act No. 19653, Apr. 18, 2023>
차마 또는 노면전차의 운전자는 노인 보호구역 또는 장애인 보호구역에서 제1항에 따른 조치를 준수하고 노인 또는 장애인의 안전에 유의하면서 운행하여야 한다. <개정 2018.3.27>
Drivers of vehicles or trams shall comply with the measures under paragraph ① in senior citizen protection zones or disability protection zones and operate their vehicles with due care for the safety of senior citizens or persons with disabilities. <Amended by Act No. 15530, Mar. 27, 2018>
