제143조 전용차로 운행 등에 대한 시ㆍ군공무원의 단속

시ㆍ군공무원은 제15조제3항에 따른 전용차로 통행 금지 의무, 제29조제4항ㆍ제5항에 따른 긴급자동차에 대한 진로양보 의무 또는 제32조부터 제34조까지의 규정에 따른 정차 및 주차 금지 의무를 위반한 운전자가 있으면 행정안전부령으로 정하는 바에 따라 현장에서 위반행위의 요지와 경찰서장(제주특별자치도의 경우 제주특별자치도지사로 한다. 이하 이 조에서 같다)에게 출석할 기일 및 장소 등을 구체적으로 밝힌 고지서를 발급하고, 운전면허증의 제출을 요구하여 이를 보관할 수 있다. 이 경우 그 고지서는 출석기일까지 운전면허증과 같은 효력이 있다. <개정 2013.3.23, 2014.11.19, 2017.7.26>
When a driver violates the obligation not to use exclusive lanes under Article 15(3), the obligation to yield to emergency vehicles under Article 29(4) and (5), or the obligation not to stop or park under Articles 32 through 34, a city or county official may issue a notice on the spot, as prescribed by the Ministry of the Interior and Safety, specifying the gist of the violation, and the date and place for appearance at the police station (or the Governor of Jeju Special Self-Governing Province in the case of Jeju Special Self-Governing Province; hereinafter the same shall apply in this Article), and may demand the submission of the driver's license for safekeeping. 시ㆍ군공무원은 제1항에 따라 고지서를 발급한 때에는 지체 없이 관할 경찰서장에게 운전면허증을 첨부하여 통보하여야 한다.
When a city or county official issues a notice under Paragraph ①, the official shall promptly notify the competent police station, attaching the driver's license.
경찰서장은 제2항에 따른 통보를 받으면 위반행위를 확인하여야 한다.
Upon receiving notification under Paragraph ②, the police station shall confirm the violation.
시ㆍ군공무원은 제1항에 따라 고지서를 발급하거나 조치를 할 때에는 본래의 목적에서 벗어나 직무상 권한을 남용하여서는 아니 된다.
When issuing a notice or taking action under Paragraph ①, a city or county official shall not abuse official authority beyond its original purpose.
