제162조 통칙

이 장에서 "범칙행위"란 제156조 각 호 또는 제157조 각 호의 죄에 해당하는 위반행위를 말하며, 그 구체적인 범위는 대통령령으로 정한다.
In this Chapter, "offense" means a violation corresponding to the offenses in each subparagraph of Article 156 or each subparagraph of Article 157, and the specific scope thereof shall be determined by Presidential Decree.
이 장에서 "범칙자"란 범칙행위를 한 사람으로서 다음 각 호의 어느 하나에 해당하지 아니하는 사람을 말한다.
1. 범칙행위 당시 제92조제1항에 따른 운전면허증등 또는 이를 갈음하는 증명서를 제시하지 못하거나 경찰공무원의 운전자 신원 및 운전면허 확인을 위한 질문에 응하지 아니한 운전자
2. 범칙행위로 교통사고를 일으킨 사람. 다만, 「교통사고처리 특례법」 제3조제2항 및 제4조에 따라 업무상과실치상죄ㆍ중과실치상죄 또는 이 법 제151조의 죄에 대한 벌을 받지 아니하게 된 사람은 제외한다.
In this Chapter, "offender" means a person who has committed an offense, excluding a person who falls under any of the following subparagraphs: 1. A driver who, at the time of the offense, failed to present a driver's license, etc. under Article 92 (1) or a certificate substituting therefor, or failed to respond to a police officer's questions for the purpose of verifying the driver's identity and driver's license. 2. A person who caused a traffic accident due to the offense. However, this shall exclude a person who is not punished for the offense of causing injury due to professional negligence or gross negligence under Article 3 (2) and Article 4 of the Act on Special Cases Concerning the Settlement of Traffic Accidents, or for an offense under Article 151 of this Act.
이 장에서 "범칙금"이란 범칙자가 제163조에 따른 통고처분에 따라 국고(國庫) 또는 제주특별자치도의 금고에 내야 할 금전을 말하며, 범칙금의 액수는 범칙행위의 종류 및 차종(車種) 등에 따라 대통령령으로 정한다.
In this Chapter, "fine for violation" means money that an offender must pay to the national treasury or the treasury of Jeju Special Self-Governing Province according to the notification disposition under Article 163, and the amount of the fine for violation shall be determined by Presidential Decree according to the type of offense and vehicle class, etc.
