Article 45 (Prohibition of Driving When Fatigued, etc.)
제45조 과로한 때 등의 운전 금지

자동차등(개인형 이동장치는 제외한다. 이하 이 조에서 같다) 또는 노면전차의 운전자는 제44조에 따른 술에 취한 상태 외에 과로, 질병 또는 약물의 영향과 그 밖의 사유로 정상적으로 운전하지 못할 우려가 있는 상태에서 자동차등 또는 노면전차를 운전하여서는 아니 된다. <개정 2025.12.30>
A driver of a motor vehicle, etc. (excluding personal mobility devices; hereinafter the same applies in this Article) or a tram shall not drive a motor vehicle, etc. or a tram when in a state where there is a risk of not being able to drive normally due to fatigue, illness, the influence of drugs, or other reasons, in addition to the state of intoxication as prescribed in Article 44. <Amended by Act No. X, December 30, 2025>
경찰공무원은 약물의 영향으로 정상적으로 운전하지 못할 우려가 있는 상태에서 자동차등 또는 노면전차를 운전하였다고 인정할 만한 상당한 이유가 있는 경우에는 운전자가 약물을 복용하였는지를 타액 간이시약검사 등 행정안전부령으로 정하는 방법으로 측정할 수 있다. 이 경우 운전자는 경찰공무원의 측정에 응하여야 한다. <신설 2025.4.1>
If a police officer has reasonable grounds to believe that a driver of a motor vehicle, etc. or a tram has driven while under the influence of drugs to the extent that normal driving is impossible, the police officer may measure whether the driver has taken drugs using methods prescribed by the Ministry of the Interior and Safety, such as a saliva rapid reagent test. 제2항에 따른 측정 결과에 불복하는 운전자에 대하여는 그 운전자의 동의를 받아 혈액 채취 등 행정안전부령으로 정하는 방법으로 다시 측정할 수 있다. <신설 2025.4.1>
For a driver who disputes the results of the measurement under paragraph ②, a re-measurement may be conducted by methods prescribed by the Ministry of the Interior and Safety, such as blood collection, with the consent of the driver. <Newly established by Act No. Y, April 1, 2025>
