Article 49 (Matters to be Observed by All Drivers, etc.)

Every driver of a motor vehicle or tram shall observe the following: 1. When driving through a place where water is accumulated, not to splash the accumulated water and cause damage to others. 2. To stop temporarily in any of the following cases: a. When a child is found crossing the road without a guardian, sitting or standing on the road, or playing on the road, and there is a risk of a traffic accident involving the child. b. When a visually impaired person is crossing the road, by carrying a white cane or accompanied by a guide dog, etc. c. When a person with a physical disability or an elderly person, who cannot use road crossing facilities such as underpasses or overpasses, is crossing the road. 3. Not to drive a vehicle in which the visible light transmittance of the front windshield and the left and right side windows of the driver's seat is lower than the standard prescribed by the Presidential Decree, which may impede traffic safety, etc. Provided, that this shall not apply to vehicles for guarding dignitaries, ambulances, and hearses. 4. Not to drive a vehicle equipped with a device that interferes with the function of traffic enforcement equipment, or any other vehicle equipped with a device that does not meet the standards prescribed by the Ordinance of the Ministry of the Interior and Safety, which may impede safe driving. Provided, that this shall not apply to vehicles equipped with devices for the development of new technologies for autonomous driving vehicles. 5. Not to obstruct the passage of other vehicles by stopping a motor vehicle, etc. (excluding personal mobility devices; hereinafter the same in this Article) or a tram on the road and engaging in acts such as arguments or disputes. 6. When leaving a motor vehicle or tram, to take necessary measures to prevent traffic accidents and to prevent others from driving it without permission. 7. Drivers shall not open the doors of a motor vehicle or tram or alight therefrom without confirming safety, and shall take necessary measures to prevent passengers from causing a danger to traffic. 8. Drivers shall not generate noise that causes damage to others by committing any of the following acts without just cause: a. Rapidly starting a motor vehicle, etc. or rapidly increasing its speed. b. Increasing the engine speed without transmitting the engine power of a motor vehicle, etc. to the wheels of the vehicle. c. Repeatedly or continuously sounding the horn. 9. Drivers shall not operate a motor vehicle or tram while allowing passengers to engage in disruptive behavior such as dancing inside the vehicle to a degree that significantly hinders safe driving. 10. Drivers shall not use a portable telephone (including a car telephone) while driving a motor vehicle, etc. or a tram. Provided, that this shall not apply to any of the following cases: a. When the motor vehicle, etc. or tram is stopped. b. When driving an emergency vehicle. c. In cases of urgent necessity, such as reporting various crimes and disasters. d. When using a device prescribed by the Presidential Decree that does not hinder safe driving. 11. While driving a motor vehicle, etc. or a tram, not to display images in a position where the driver can see them while driving, through a device that receives or plays video content such as broadcasts (including devices carried by the driver; hereinafter referred to as "video display device"). Provided, that this shall not apply to any of the following cases: a. When the motor vehicle, etc. or tram is stopped. b. When the following video content is displayed on a video display device installed or mounted on a motor vehicle, etc. or tram: 1) Geographic guidance video or traffic information guidance video. 2) Video guiding urgent situations such as national emergencies or disaster situations. 3) Video that helps the driver see the left or right, or the front and rear of the motor vehicle, etc. or tram when driving. 11. While driving a motor vehicle, etc. or a tram, not to operate a video display device. Provided, that this shall not apply to any of the following cases: a. When the motor vehicle, etc. and tram are stopped. b. When the tram driver operates a video display device necessary for driving. 12. Drivers shall not drive with people in the cargo area of a motor vehicle. 13. To comply with other matters designated and publicly announced by the Provincial Police Agency Commissioner as necessary for traffic safety and maintaining traffic order.
