제71조 도로의 위법 인공구조물에 대한 조치

경찰서장은 다음 각 호의 어느 하나에 해당하는 사람에 대하여 위반행위를 시정하도록 하거나 그 위반행위로 인하여 생긴 교통장해를 제거할 것을 명할 수 있다. <개정 2014.1.14>
1. 제68조제1항을 위반하여 교통안전시설이나 그 밖에 이와 비슷한 인공구조물을 함부로 설치한 사람
2. 제68조제2항을 위반하여 물건을 도로에 내버려 둔 사람
3. 「도로법」 제61조를 위반하여 교통에 방해가 될 만한 인공구조물 등을 설치하거나 그 공사 등을 한 사람
A police station chief may order a person falling under any of the following subparagraphs to correct the act of violation or to remove traffic obstruction caused by such act of violation. <Amended by Act No. 12236, Jan. 14, 2014> 1. A person who has carelessly installed traffic safety facilities or other similar artificial structures in violation of Article 68 (1). 2. A person who has left an object on a road in violation of Article 68 (2). 3. A person who has installed artificial structures that may obstruct traffic or has carried out construction thereof in violation of Article 61 of the 「Road Act」.
경찰서장은 제1항 각 호의 어느 하나에 해당하는 사람의 성명ㆍ주소를 알지 못하여 제1항에 따른 조치를 명할 수 없을 때에는 스스로 그 인공구조물 등을 제거하는 등 조치를 한 후 보관하여야 한다. 이 경우 닳아 없어지거나 파괴될 우려가 있거나 보관하는 것이 매우 곤란한 인공구조물 등은 매각하여 그 대금을 보관할 수 있다.
When a police station chief cannot order measures under paragraph (1) because the name and address of a person falling under any subparagraph of paragraph (1) are unknown, the police station chief shall take measures such as removing the artificial structures himself/herself and keep them in custody. In this case, if the artificial structures are likely to wear out or be destroyed, or if keeping them in custody is extremely difficult, they may be sold and the proceeds kept in custody.
제2항에 따른 인공구조물 등의 보관 및 매각 등에 필요한 사항은 대통령령으로 정한다.
Matters necessary for the custody and sale, etc. of artificial structures under paragraph (2) shall be prescribed by Presidential Decree.
