제74조 교통안전교육기관의 지정 등

제73조제1항에 따라 운전면허를 받으려는 사람이 받아야 하는 교통안전교육(이하 "교통안전교육"이라 한다)은 제104조제1항에 따른 자동차운전 전문학원과 제2항에 따라 시ㆍ도경찰청장이 지정한 기관이나 시설에서 한다. <개정 2020.12.22>
The traffic safety education (hereinafter referred to as "traffic safety education") that a person who intends to obtain a driver's license pursuant to Article 73 (1) must receive shall be conducted at driving schools for automobiles under Article 104 (1) and at institutions or facilities designated by the Chief of the Provincial Police Agency pursuant to Paragraph (2). <Amended by Act No. 17790, Dec. 22, 2020>
시ㆍ도경찰청장은 교통안전교육을 하기 위하여 다음 각 호의 어느 하나에 해당하는 기관이나 시설이 대통령령으로 정하는 시설ㆍ설비 및 강사 등의 요건을 갖추어 신청하는 경우에는 해당 기관이나 시설을 교통안전교육을 하는 기관(이하 "교통안전교육기관"이라 한다)으로 지정할 수 있다. <개정 2020.12.22, 2024.1.30>
1. 제99조에 따른 자동차운전학원
2. 한국도로교통공단과 그 지부(支部)ㆍ지소 및 교육기관
3. 「평생교육법」 제30조제2항에 따른 평생교육과정이 개설된 대학 부설 평생교육시설
4. 제주특별자치도 또는 시ㆍ군ㆍ자치구에서 운영하는 교육시설
The Chief of the Provincial Police Agency may designate an institution or facility as an institution that conducts traffic safety education (hereinafter referred to as "traffic safety education institution") if it meets the requirements for facilities, equipment, and instructors, etc., as prescribed by Presidential Decree, and applies for such designation. <Amended by Act No. 17790, Dec. 22, 2020; Act No. 19940, Jan. 30, 2024> 1. Driving schools for automobiles under Article 99. 2. Korea Road Traffic Authority and its branches, liaison offices, and educational institutions. 3. Lifelong education facilities attached to universities where lifelong education courses are established pursuant to Article 30 (2) of the Lifelong Education Act. 4. Educational facilities operated by Jeju Special Self-Governing Province or cities/counties/autonomous districts.
시ㆍ도경찰청장은 제2항에 따라 교통안전교육기관을 지정한 경우에는 행정안전부령으로 정하는 지정증을 발급하여야 한다. <개정 2013.3.23, 2014.11.19, 2017.7.26, 2020.12.22>

시ㆍ도경찰청장은 다음 각 호의 어느 하나에 해당하는 기관이나 시설을 교통안전교육기관으로 지정하여서는 아니 된다. <개정 2020.12.22>
1. 제79조에 따라 지정이 취소된 교통안전교육기관을 설립ㆍ운영한 자가 그 지정이 취소된 날부터 3년 이내에 설립ㆍ운영하는 기관 또는 시설
2. 제79조에 따라 지정이 취소된 날부터 3년 이내에 같은 장소에서 설립ㆍ운영되는 기관 또는 시설
The Chief of the Provincial Police Agency shall not designate the following institutions or facilities as traffic safety education institutions. <Amended by Act No. 17790, Dec. 22, 2020> 1. An institution or facility established and operated by a person who established and operated a traffic safety education institution whose designation was revoked under Article 79, within 3 years from the date of revocation of its designation. 2. An institution or facility established and operated at the same location within 3 years from the date of revocation of its designation under Article 79.
